The case of 4 victims in a family in Hanoi: Will the mentally ill perpetrator escape the death penalty?

The case of 4 people in the same family being murdered in Phu Xuyen district (Hanoi) has become a hot topic, attracting public attention and discussion in recent days due to the seriousness and behavior of the perpetrator.

On January 19, Hanoi City Police prosecuted Vu Van Vuong (52 years old, Phu Xuyen district, Hanoi) for murder. At the police station, Vu Van Vuong admitted that on January 15, he used a sharp object to send his wife and two children to the other world and then continued to do the same to his biological mother.

After committing the crime, Vuong wrote a letter and took sleeping pills to follow his family but did not die. On the afternoon of January 16, Vuong took a bus from Hanoi to Da Nang, then from Da Nang to Ba Ria - Vung Tau. On January 18, Hanoi City Police coordinated with the professional departments of the Ministry of Public Security and Ba Ria - Vung Tau Provincial Police to arrest him, then extradited him to Hanoi to serve the investigation.

According to Vu Van Vuong's initial statement, just because he wanted to free everyone in his family because they were too poor, he planned, prepared weapons, and took advantage of the victims' defenseless state to attack...

From a legal perspective, Lawyer Nguyen Hoang - Hanoi Bar Association said that this is an extremely serious case; with the tragic consequence of 4 deaths. The suspect's actions have violated the right to life of citizens - the highest subject protected by law, so there are signs of constituting the crime of Murder.

With circumstances such as attacking two or more people, especially the biological mother and being a hooligan... the suspect may face the highest sentence of death penalty (according to Article 123 of the 2015 Penal Code). During the investigation, if there is evidence to determine that the suspect has abnormal psychological symptoms or has been treated for mental illness, a forensic psychiatric assessment can be requested for handling according to regulations.

Article 21 of the 2015 Penal Code clearly states that a person who commits an act that is dangerous to society while suffering from a mental illness or other illness that causes loss of cognitive ability or ability to control behavior shall not be held criminally responsible. Therefore, a person who commits a murder will not be held criminally responsible if he commits a crime while suffering from a mental illness.

If the assessment results show that the person who committed the act was dangerous to society while suffering from a mental illness, the authorities will send them to a specialized treatment facility for compulsory treatment without having to bear criminal responsibility for the act they committed.

According to Lawyer Nguyen Hoang, in reality, there are some individuals who, although suffering from mental illness and undergoing treatment, were completely normal at the time of committing the crime, but still have to bear criminal responsibility. In this case, the court may decide to send them to a specialized treatment facility for compulsory treatment.

After recovering from the illness, the subject may be held criminally responsible. In addition, if the suspect has a mental illness but does not completely lose the ability to control his behavior, he will still be responsible for his criminal behavior... Thus, once Vu Van Vuong's mental state has been determined, the court will have a verdict corresponding to his criminal behavior.

Previously, at around 2:30 p.m. on January 17, Mr. VVS's family discovered that Ms. D.TN (born in 1946; in Kim Long Trung village, Hoang Long commune, Phu Xuyen district, Hanoi - is Mr. VVS's aunt) had no signs of life while lying on the bed in the living room.

Later, the family continued to discover that Ms. N's daughter-in-law, Ms. D.TT (born in 1975), her son born in 2008 and her daughter born in 2006 all died under the bed in the bedroom next to the living room. Mr. VVS's family reported the news to the Phu Xuyen District Police.
