Duc Tien's wife spoke out before the property dispute trial, her mother-in-law asked to divide the house?

After the first instance verdict in the inheritance dispute of the late actor Duc Tien, both his biological mother and wife filed an appeal, arguing that the verdict affected each person's legal rights.
On November 26, regarding the inheritance dispute of the late actor Duc Tien, Ms. Nguyen Binh Phuong - the late actor's wife - officially filed a partial appeal against the first instance judgment of the Ho Chi Minh City People's Court.
According to the appeal, Ms. Phuong argued that some contents of the first instance judgment had infringed on her legitimate rights. She requested the appellate court to reconsider and recognize that she owned 50% of the value of the house in Linh Dong ward, Thu Duc city (old) and 50% of the value of the land plot in Duc Hoa district, old Long An province (now Tay Ninh province).
Ms. Phuong also disagreed with the decision of the first instance court that Ms. Nguyen Ngoc Anh - the late actor's biological mother - was entitled to 10% of the value of the house in Linh Dong ward because she "managed and restored the property". The reason Ms. Phuong gave was that the entire amount of money to buy these properties was transferred from abroad by the late actor Duc Tien, with absolutely no financial contribution from Ms. Anh. Ms. Anh's care of the house was only a temporary agreement, not to create property.
In addition, Ms. Phuong also requested the court to determine the estate of the late actor Duc Tien after deducting reasonable expenses related to medical treatment and burial in the US.
Previously, Ms. Nguyen Ngoc Anh also filed an appeal against the first instance judgment. Ms. Anh argued that the first instance court had not fully evaluated the evidence, leading to an unbiased application of the law and affecting her legitimate rights. Accordingly, Ms. Anh requested the appellate court to amend the judgment to accept all of her counterclaims and reject all of Ms. Nguyen Binh Phuong's lawsuits.
According to the first instance verdict on October 28, after actor Duc Tien passed away in the US, a dispute arose between Ms. Nguyen Binh Phuong and the late actor's biological mother - Ms. Nguyen Ngoc Anh - over the house in Quarter 7, Linh Dong Ward, Ho Chi Minh City and land plot No. 1841 in Duc Lap Thuong Commune, Duc Hoa District, Long An Province (now Tay Ninh Province).
The first instance judgment determined that the entire house and land were the legacy of the late actor Duc Tien. The will that the late actor left behind was considered legal and in accordance with the Civil Code. The court determined that there was no basis to prove that the house and land in Linh Dong ward was the joint property of Ms. Phuong and the late actor, nor was it the joint property of Ms. Anh and her son. However, the court acknowledged that since 2009, Ms. Anh had contributed to the care, management and payment of land and house taxes, so she was entitled to 10% of the house's value.
Regarding the land plot in Tay Ninh, the court determined that the late actor Duc Tien owned 70%, and Ms. Binh Phuong 30%. All the real estate in Linh Dong ward is his private property. The total value of the assets in Vietnam is 7.2 billion VND; after deducting 10% of Ms. Anh's renovation efforts, there is 6.3 billion VND left, divided according to the will. The panel of judges determined that the heirs include mother, wife and children. Ms. Anh and her children each received 1.4 billion VND; Ms. Anh added 10% of the house value (~720 million), totaling more than 2 billion. Ms. Phuong received more than 3 billion, received both her child's inheritance and returned the value to Ms. Anh.
