According to the lawyer: "As for the defendant Hang, according to the investigation conclusion, the investigation agency has noted that during the process of resolving the case, the defendant actively cooperated with the investigation. The defendant Hang is a rather special case. When her child was just one year old, the defendant wrote a voluntary application to stay and cooperate with the work. When the defendant was prosecuted, she shared with us that up to now, she still has milk to feed her child, and the defendant still expresses milk every day. This is a detail that the trial panel considered and considered for the defendant."

From a legal perspective, Dr. - Lawyer Dang Van Cuong (Hanoi Bar Association) explained that the law has provisions on considering the circumstances of pregnant women or those raising children under 36 months old. According to him, the law allows the application of humanitarian policies such as changing preventive measures, bail or postponing the execution of sentences, but this does not mean that all cases are eligible.

He cited Article 67 of the Penal Code, which stipulates the postponement of prison sentences in some special cases, including women who are pregnant or raising children under 36 months old. However, the wording in the law is "may be postponed", meaning that the court will consider each specific case, not "mandatory".

Attorney Cuong emphasized that the core condition for considering a stay of execution is that the defendant is raising a child under 36 months old, not based on whether the mother is still breastfeeding or not. If the child is older than 36 months or the prosecution agency finds it unnecessary to postpone, the execution of the sentence will still be carried out in accordance with regulations.
