Ms. Nguyen Ngoc Anh has just filed an appeal against the first-instance judgment in the dispute over the inheritance of the late actor Duc Tien, asking the appellate court to accept the counterclaim and protect her legitimate interests.
Ms. Nguyen Ngoc Anh has filed an appeal to the Ho Chi Minh City People's Court regarding the first-instance judgment pronounced on October 28. In the application, Ms. Anh said: "The People's Court of Ho Chi Minh City has not comprehensively and fully evaluated the documents and evidence in the case file, there is confusion in the application of the law, leading to the issuance of the first-instance judgment that is not objective as well as does not ensure my legitimate rights and interests."
Ms. Anh's appeal requested the appellate court to amend the first-instance judgment in the direction of accepting all of her counterclaims and rejecting all lawsuit requests of Ms. Nguyen Binh Phuong, wife of the late actor Hoang Duc Tien.
This inheritance dispute case was reported by Tien Phong on October 28. According to the first-instance judgment, the Ho Chi Minh City People's Court heard the dispute between the plaintiff Nguyen Binh Phuong and the defendant Nguyen Ngoc Anh. The Judicial Council declared that it accepted part of the requests of both the plaintiff and the defendant, but many contents were still controversial.
Specifically, for the plaintiff's request to recognize the house in Linh Dong ward (old) and the land plot in Long An province (old) as the common property of Ms. Phuong and her husband, as well as the division of the inheritance according to the will of the late actor Duc Tien, the Judicial Council said: The house in Linh Dong ward (old) was formed before the marriage period, so it is Mr. Tien's private property. The land plot in Long An province (old), the Board of Directors determined that there was 40% of the value formed before the marriage period, the rest was the common property of Ms. Phuong and her husband.
On the defendant's side, the request to recognize the house in Linh Dong ward (old) as common property between Ms. Anh and the late actor Duc Tien was rejected by the court. However, the Board of Trustees accepted the request to recognize Ms. Anh's efforts to manage and preserve her heritage, whereby she was entitled to 10% of the value of the house in Linh Dong ward (old).
Another important issue is the will left by the late actor Duc Tien. Ms. Anh asked the court not to recognize this will, but the Judicial Council considered that there were sufficient legal grounds to determine the legal will, so the estate would be divided according to the content of the will. However, according to the inheritance law, the first line of inheritance includes the mother, wife and children of the deceased. While the will leaves all the assets to Ms. Phuong, the children of the late actor are not yet 18 years old and the mother are the subjects of compulsory inheritance, regardless of the content of the will. Therefore, Ms. Anh and Mr. Duc Tien's children are still entitled to the inheritance in accordance with the law.
The first-instance judgment has created many controversies around the division of the inheritance, especially the value of the house in Linh Dong and the land plot in Long An, as well as the legal rights of Ms. Anh and the children of the late actor Duc Tien. Ms. Anh's appeal is considered an important step to protect her rights in this complex case.
Currently, the People's Court of Ho Chi Minh City will review the appeal and issue a decision to settle it at the appellate level, which is expected to clarify the disputed contents, ensure the legitimate interests of the parties involved, and clarify how to apply the law on inheritance and inheritance in case of a will.
