At around 9:00 p.m. on September 15, Mr. T.D. (born in 1989, from Hoi An City, Quang Nam) was driving a motorbike and stopped at a red light at the intersection of Tong Van Tran - Lac Long Quan when he was suddenly checked by the Traffic Police - Order Team of District 11 Police, and found to have an alcohol concentration of 0.428 mg/liter of breath.
The male driver was fined 7 million VND by the task force, had his driver's license revoked for 23 months, and had his vehicle impounded for 7 days. Mr. D. said he worked as a construction worker. That evening, he stopped by a friend's house to drink 6 cans of beer, and on the way back to his rented room 1km away, he was stopped and fined by the traffic police.
About 3 months ago, Mr. D. drank 0.5 liters of alcohol and was fined by the traffic police at this intersection. Not having money to pay the fine, he abandoned his vehicle and returned to his hometown. He returned to Ho Chi Minh City about a month ago and continued to drink beer and was checked by the traffic police.
"In my hometown, it's stormy this season, I can't go fishing at sea, so I came to Ho Chi Minh City to work as a construction worker. This time, I'll probably abandon my car and go back to my hometown because I don't have money to pay the fine," Mr. D. signed the report and burst into tears. This driver said he would go to the Eastern Bus Station to buy a ticket home at night because he had no other means of transportation to work.
About 30 minutes later, Mr. TVÄ. (born in 1961, residing in District 11) was driving a motorbike on Lac Long Quan Street and was also checked by the Traffic Police and found to have an alcohol concentration of 0.700 mg/liter of breath. The working group made a record of Mr. V.Ä. and fined him 7 million VND.
"I drank 6 cans of beer at an acquaintance's house on Tong Van Tran Street, District 11. On the way home, 500m away, I was stopped by the police. My house is close so I drove home," said Mr. V.D.
At the same time, Mr. TTT (born in 1983) was also checked by traffic police and found to have an alcohol concentration of 0.278 mg/liter of breath while driving his motorbike from the parking lot on Tong Van Tran Street (District 1) home.
Mr. T. said he works as a truck driver. After driving the vehicle into the parking lot, he drank a can of beer with his colleague. On the way home, he was stopped by the traffic police. "I don't dare drink too much because I have to go to work early tomorrow. Drinking a can of beer will result in a fine of 4.5 million VND, which is too expensive," the driver said.
A traffic police officer said that the alcohol concentration test aims to propagate people to strictly obey traffic laws, and that if they have consumed alcohol, they should not drive to ensure their own safety and that of others. This helps families to be happy and avoids unfortunate accidents.
Article 6 of Decree No. 100/2019/ND-CP (amended and supplemented by Decree No. 123/2021/ND-CP) stipulates that motorcyclists who violate alcohol concentration will be fined from 2 to 8 million VND (depending on the alcohol concentration measured by the traffic police).
For motorbikes, drivers on the road with a blood or breath alcohol concentration that does not exceed 50 milligrams/100 milliliters of blood or does not exceed 0.25 milligrams/1 liter of breath will be fined from VND 2,000,000 to VND 3,000,000; their driving license will be revoked for 10 to 12 months.
A driver on the road with a blood or breath alcohol concentration exceeding 50 milligrams to 80 milligrams/100 milliliters of blood or exceeding 0.25 milligrams to 0.4 milligrams/1 liter of breath shall be fined from 4,000,000 VND to 5,000,000 VND; his/her driving license shall be revoked for 16 to 18 months.
A driver on the road with a blood or breath alcohol concentration exceeding 80 milligrams/100 milliliters of blood or exceeding 0.4 milligrams/1 liter of breath shall be fined from 6,000,000 VND to 8,000,000 VND; and his/her driving license shall be revoked for 22 to 24 months.
On the other hand, in case the violator intentionally refuses to sign the record, the authorities have the right to create a record and handle the case if it is proven that the driver did not cooperate (with evidence to prove it).
Specifically, if a motorcyclist violates the alcohol concentration and leaves the vehicle behind, does not sign the violation report, he/she may be fined from 4 to 6 million VND for individuals (from 8 to 12 million VND for organizations) for obstructing or not complying with the request for inspection and control of law enforcement forces as prescribed in Clause 9, Article 11 of Decree No. 100/2019/ND-CP.
