Truong My Lan can escape death, her husband and niece have their sentences reduced for this reason!

Recently, the appellate court sentenced Ms. Truong My Lan in the Van Thinh Phat case (phase 1). Meanwhile, her husband and granddaughter were considered for sentence reduction.

On the morning of December 3, the High People's Court in Ho Chi Minh City. Ho Chi Minh City has sentenced Ms. Truong My Lan (Chairman of Van Thinh Phat Group) to 16 years in prison for violating regulations on lending in the operation of credit institutions, 20 years in prison for giving bribes. According to the Board of Directors, Ms. Truong My Lan is the owner of many different companies, operating under a group model in which Van Thinh Phat Company plays a central role. Before consolidating SCB, Ms. Lan borrowed from 3 banks to implement real estate projects.

After knowing that the above 3 banks were incapable, Ms. Lan bought back the shares of these banks. In October 2012, after the merger, she accounted for 91.5% of SCB's shares, then directed key leaders at SCB and Van Thinh Phat to prepare false documents and withdraw money from banks.

From 2012 to 2017, Truong My Lan directed the preparation of false documents for 304 customers, borrowed 368 items. By 2022, these loans have outstanding loans of more than VND 132,000 billion in both principal and interest. After deducting from the collateral, the loans caused a loss of VND 64,600 billion. Ms. Lan's behavior during this period violated regulations on lending in the operation of credit institutions.

From February 2018 to October 2022, Ms. Lan directed the preparation of 916 loan applications of SCB of VND 545,000 billion, appropriating VND 304,000 billion; causing losses of nearly VND 130,000 billion in interest. Due to the change in the handling of violations occurring before and after January 1, 2018 (the Criminal Code 2015 takes effect), this act of Ms. Lan commits the crime of embezzlement of property.

In addition, in order to hide the weak situation of SCB and help the bank escape from special control, Ms. Lan also directed her subordinates to bribe the inspection team. In which, Vo Tan Hoang Van (general director of SCB) gave Ms. Do Thi Nhan (Director of Inspection and Supervision of the State Bank) 4 times the amount of 5.2 million USD; giving money and gifts to members of the inspection team to cover up wrongdoing, creating conditions for SCB to continue restructuring.

The jury assessed that Truong My Lan committed the crime as an organization and directed other defendants, at the same time to commit 3 criminal acts, causing particularly large damage. Therefore, the court of first instance sentenced the common penalty for all 3 crimes: the right person and the right crime.

The court also noted that if the defendant Lan actively remedies 3/4 of the consequences of the case after the judgment takes effect, equivalent to at least 280,000 billion VND, he can be considered to change from a prison sentence to a life sentence.

For Ms. Lan's husband, the defendant Chu Lap Co (Chairman of the Board of Directors of Times Square Vietnam Joint Stock Company), the Appellate Tribunal sentenced him to 9 years in prison after being sentenced to 9 years in prison by the first-instance People's Council of Ho Chi Minh City, for the crime of "Violating regulations on lending in the operation of credit institutions", Mr. Co appealed.

The Appellate Tribunal considered mitigating the penalty and found that Mr. Chu Lap Co's appeal was well-founded; in this case, Mr. Co committed the crime with a secondary role, after the first-instance judgment, he paid an additional 2.5 billion VND to overcome the consequences... In the end, the Appellate Council decided to reduce the sentence for Ms. Lan's husband, from 9 years in prison to 7 years.

The Judicial Council also announced to accept the appeal for penalty reduction of the defendant Truong Hue Van (General Director of Windsor Real Estate Management Group Company, Ms. Lan's granddaughter), thereby reducing the sentence from 17 years in prison for the crime of "Embezzlement of property" of the first-instance sentence, to 13 years in prison.

According to the Judicial Council, the reason why the defendant Truong Hue Van was considered for sentence reduction was because after the first-instance judgment, the defendant paid an additional 2.5 billion VND to remedy the consequences and actively participated in social activities.
