However, recently, Ngoc Trinh's social networking sites such as fanpages with more than 2.7 million favorites, 5.9 million followers, personal facebook with more than 3 million followers, Instagram 5.7 million followers suddenly "lit up". Images posing on the side of the motorcycle and also video clips show this model riding a motorcycle without protective gear with offensive positions such as lying down, kneeling on the saddle ... has ceased to exist.
Although these websites only "lit up" after nearly 1 day and continued to be locked and inaccessible, however, some comments suggested that Ngoc Trinh may have been released on bail after being detained. Recently, some press agencies quoted sources as saying that Ngoc Trinh is still being detained by the Ho Chi Minh City Police Department for investigation for "disrupting public order".
Dr. Dang Van Cuong, a lawyer from the Hanoi Bar Association, said that from the information provided by the police agency, it is possible that Ngoc Trinh can only be prosecuted under Clause 1, Article 318 of the Penal Code with a penalty frame of a fine from VND 5,000,000 to VND 50,000,000, a non-custodial rehabilitation penalty of up to 2 years or imprisonment from 3 months to 2 years. Temporary detention shall only be applied to defendants prosecuted for less serious and serious crimes if the accused has no clear residence, shows signs of absconding, obstructs investigation activities, etc.
Article 119 of the 2015 Criminal Procedure Code stipulates that the subjects to apply detention measures are the accused or defendants in the following cases: Defendants or defendants who commit very serious crimes or especially serious crimes; An accused or defendants who commit serious crimes or less serious crimes for which the Penal Code provides for imprisonment for more than 2 years and in cases where there are grounds to believe that such person may evade or need to obstruct the investigation, prosecution, trial or may continue to commit the crime.

Only in exceptional cases such as committing serious crimes, committing very serious crimes, committing particularly serious crimes and there are grounds to believe that if not detained, the person may evade or obstruct the investigation or trial or may continue to commit the crime, will he be detained.
Lawyer Cuong said that if he disagreed with the detention decision, Ngoc Trinh had the right to appeal against this decision. The investigating agency will also explain and clarify under which clause of the law Ngoc Trinh has been prosecuted, whether it is a less serious crime or a serious crime and the grounds for detention in this case. If the explanation is not satisfactory or disagrees with the detention decision, the accused has the right to lodge a complaint in accordance with law.
