The investigating police agency determined that Ngoc Trinh did not have a class A2 motorbike driving license, but on October 6, Ngoc Trinh was driving a motorbike with license plate number 59A3-115.88 (BMW brand, cylinder capacity 999cm3) in circulation. Authorities stepped in to verify and administratively fine Ngoc Trinh for violating the Road Traffic Law. Specifically, the female model drove her motorbike in violation of driving a vehicle with a hidden license plate, without a vehicle registration, and without a driver's license. Ngoc Trinh's total administrative fine is more than 17 million VND.

Regarding the fact that Ngoc Trinh was detained for 3 months despite previously being administratively fined, many people expressed confusion. He informed that Article 318 of the 2015 Penal Code, amended and supplemented in 2017, stipulates the crime of disturbing public order as follows:

People who disrupt public order and adversely affect security, order, and social safety have either been administratively sanctioned for this act or have been convicted of this crime and have not yet had their criminal records expunged. Violators will be fined from 5-50 million VND, non-custodial reform for up to 2 years or imprisonment from 3 months to 2 years.

Based on this regulation, according to lawyer Hung, objectively, criminals have committed acts of disturbing public order, disregarding order in crowded places such as markets, schools... The basis for criminal prosecution for acts of disturbing public order is that they cause a negative impact on security, order, and social safety or have been administratively sanctioned for this act or have been convicted. Regarding this crime, the criminal record has not been erased but is still being violated.

Lawyer Hung shared that it is possible that the authorities believe that model Ngoc Trinh's behavior has a negative impact on security, order, and social safety. In addition, Ngoc Trinh has a high number of followers on social networks, so her videos will affect her fans, easily causing negative effects for others. After being administratively fined, the clip was requested to be removed but Ngoc Trinh did not remove it... so maybe that was the reason the authorities prosecuted the case and prosecuted the accused.
