Duc Tien's inheritance dispute trial "heated up" when the late artist's stepmother suddenly appeared and testified. Her testimony about the origin of the property revealed many hidden corners, making the lawsuit between his wife and biological mother unpredictable.
Ho Chi Minh City â On the morning of October 28, the Peopleâs Court of Ho Chi Minh City opened the first instance trial of a complicated civil case regarding the inheritance dispute of the late actor and model Duc Tien. The plaintiff is Ms. Nguyen Binh Phuong (the late actorâs wife) and the defendant is Ms. Nguyen Ngoc Anh (63 years old), his biological mother. The trial was presided over by Judge Chau Thi Diep.
Plaintiff's Absence and Surprise Witness
At the trial, the plaintiff, Ms. Nguyen Binh Phuong, was absent, authorizing a representative and lawyer to participate in the proceedings. The defendant, Ms. Nguyen Ngoc Anh, was present with a lawyer to protect her rights. Notably, the trial had the presence of Ms. DTS (stepmother, 58 years old), who raised Duc Tien since he was a child, and Mr. MTT, his assistant for more than 10 years. Both were accepted by the panel of judges to attend as witnesses to clarify the origin of the assets.
Stepmother Asserts the Origin of the Property
In her testimony, Ms. DTS said that she was the one who directly raised Duc Tien from grade 9 until adulthood. She expressed pride in her son's marriage to Ms. Nguyen Binh Phuong, and assessed the late actor's wife as an educated and influential person. In particular, Ms. S. affirmed in court that the money to buy the land plot in Tay Ninh was the property of Duc Tien and his wife. This testimony was also confirmed by witness MTT, reinforcing the plaintiff's argument about the joint property.
Late Actor's Wife's Argument: Recognition of Will and Adjustment of Expenses
The plaintiff's lawyers argued that the will made by Duc Tien was legal under Vietnamese law. They requested that the house in Ho Chi Minh City and the land plot in Tay Ninh be recognized as the couple's joint property. After deducting medical and funeral expenses, the remaining amount would be divided in half, with Duc Tien's portion divided between his biological mother and minor daughter according to the will. Ms. Phuong's authorized representative also announced the partial withdrawal of the lawsuit request, readjusting the expenses that had been paid by insurance, with the total amount to be deducted from the inheritance being 906 million VND.
Biological Mother Requests to Cancel Will and Requests Real Property
On the contrary, the defendant, Ms. Nguyen Ngoc Anh, requested that the panel of judges not recognize the legal value of the will made in the US in Vietnam. Regarding the house in Hiep Binh Ward, Ho Chi Minh City, Ms. Anh requested to divide it in half according to the law and requested to receive the house as an object. Regarding the land plot in Tay Ninh, she claimed that this was the property she and her son bought together, but admitted that there were no documents to prove it.
Foreign Assets Resolution
Regarding the house in the US, the panel of judges clearly announced that Vietnamese courts do not have jurisdiction over assets located abroad. If there is a request to file a lawsuit on this issue, the parties must file a petition in the local court in the US. The trial will continue to clarify the legal value of the will, the origin of the assets and the requirements related to the division of inheritance according to the law.
