On the afternoon of October 28, the trial of the inheritance dispute of the late actor and model Duc Tien took place in Ho Chi Minh City, focusing on clarifying the conflicts between Ms. Nguyen Binh Phuong (wife, plaintiff) and Ms. Nguyen Ngoc Anh (biological mother, defendant).
The dispute became tense when Ms. Phuongâs legal representative could not provide a clear answer about how Ms. Phuong contributed money to buy the house and land in the inheritance block under Duc Tienâs name. However, the lawyer defending Ms. Phuongâs rights said that from the US, his client had made some adjustments in determining and dividing the inheritance.
The plaintiff firmly maintained that the late artist Duc Tien left a will, in which his wife, Ms. Phuong, was the only beneficiary of the inheritance, without the name of his biological mother. The reason given was that since childhood, Duc Tien was not cared for or raised by his biological mother. After his parents divorced in 1990, he lived with his father and two stepmothers (named H. and S.) until adulthood. The two main assets identified as inheritance in Vietnam include a house and land in Hiep Binh ward, Ho Chi Minh City, and a plot of land in Tay Ninh. The total value of these two assets is estimated at more than 7 billion VND, of which the house in Ho Chi Minh City accounts for more than 6 billion VND.
Regarding the division plan, Ms. Phuong requested the Court to recognize 50% of the value of the house in Ho Chi Minh City and 50% of the value of the land plot in Tay Ninh as the common property of the couple. As for the remaining 50%, this part is determined to be Duc Tien's inheritance. After deducting the funeral and medical expenses with a total amount of more than 2.7 billion VND, the remaining inheritance will be divided equally among three people: mother (Ms. Anh), wife (Ms. Phuong) and their children. Based on this calculation, Ms. Phuong believes that Ms. Anh will receive more than 600 million VND and will be paid in cash. Ms. Phuong also expressed her wish to receive the house in Ho Chi Minh City as a gift so that her daughter has a place to worship her father and ancestors, and also wants to receive the land plot in Tay Ninh as a gift.
On the contrary, the defendant â Ms. Nguyen Ngoc Anh, completely rejected Ms. Phuongâs arguments. Ms. Anh asserted that Duc Tienâs inheritance in Vietnam should only be 50% of the value of the house in Ho Chi Minh City. She explained that this house is jointly owned by her and her son, not the joint property of Duc Tien and Binh Phuong. Ms. Anh stated that previously, after Duc Tien sold the old houses and earned about 900 million VND, she contributed another 900 million VND to buy the house in Hiep Binh ward. She said that the fact that the house was granted a red book during the marriage period caused many people to misunderstand the nature of ownership.
Regarding financial matters, Ms. Anh did not agree to deduct the funeral and medical expenses of Duc Tien from the inheritance in Vietnam. She questioned the legality of the documents proving the expenses and said that the amount of condolence money received was very large, there could be a surplus after deducting expenses, even enough to buy insurance for Duc Tien's daughter. Therefore, she proposed that the deduction should be made in the inheritance in the US. The defendant also made a record of a social media account said to be an acquaintance of Ms. Phuong, announcing that many donors had sent money to support the funeral, build a tombstone and cash, this figure is far different from the remaining 830 USD of condolence money that Ms. Phuong's lawyer declared. Regarding the land plot in Tay Ninh, Ms. Anh agreed that this was the property that Duc Tien bought in installments during the period 2010-2015.
In the face of intense debate from both sides, the presiding judge gave a direction for resolution. The presiding judge emphasized: any party claiming to have contributed money to buy property with Duc Tien must have concrete evidence to prove it. Bringing private matters into debate will only further hurt both sides. The court will consider the legality of the will in Vietnam. At the same time, the presiding judge also said that the amount of condolence money has not been clarified, and if after deducting funeral and medical expenses there is a surplus, the remaining amount will be considered as an inheritance for inheritance.
