The inheritance dispute between Nguyen Binh Phuong, the wif.e of the late actor Hoang Duc Tien (actor Duc Tien) and the defendant, Ms. Nguyen Ngoc Anh (mother-in-law) is being accepted by the People's Court of Ho Chi Minh City.
Recently, the People's Court of Ho Chi Minh City also held a meeting to examine the handover, access, disclosure of evidence and mediation.
Because he was in the US, Binh Phuong authorized a legal representative to attend the mediation session, but this person was absent, only a lawyer participated. Ms. Ngoc Anh also did not go directly to court due to health problems, appointing a lawyer to represent her.
At the working session, the judge asked the parties to mediate but did not achieve results. The plaintiff and the defendant maintained the request to initiate a lawsuit and counterclaim.
Ms. Anh's side additionally requested to determine that the land plot in Long An was Duc Tien's private property (previously believed to be common property with Binh Phuong during the marriage period), requesting the court to adjust the inheritance rate.
Responding to the press, Binh Phuong said that she respects Duc Tien's will, avoiding statements to affect the image of the deceased. And Ms. Ngoc Anh actively works with lawyers to protect her legal rights, recently she has prepared more documents and evidence to present to the court.
After making a decision not to reconcile, Binh Phuong also released evidence affirming that she had no ill will towards her husband's family, only carrying out the will of the deceased.
Specifically, she said that her intention to sell a house in Vietnam was the intention of her late husband. He personally recorded a clip asking a broker to sell for mone.y to cover difficult times and take care of married life in the US.
In the clip that she released, the late artist Duc Tien clearly stated the reason for selling the house and introduced every corner of the house.
"Tien knows that the situation is difficult, it is not easy to sell. But Tien is in the US, rarely returns. And my mothe.r also returned to Bien Hoa, so the house was empty. Tien wants to sell this house for 14 billion. If you are goodwill, Tien would like to send a little back.
After Duc Tien's deat.h, his wif.e, Miss Binh Phuong, sent an application to the court to request to receive back her husband's assets, including a house in Linh Dong ward, Thu Duc city, Ho Chi Minh City and land plot No. 1841 in Duc Lap Thuong commune, Duc Hoa district, Long An province.
At the same time, she proposed to determine that her mother-in-law, Ms. Nguyen Ngoc Anh and her daughter, Phuong Mai, each received an inheritance of Duc Tien's property according to the law.
However, Ms. Ngoc Anh counterclaimed, saying that the house in Thu Duc was bought by her and her son in 2009, but let the chil.d be in his name. Later, Duc Tien moved to the US in 2011, she and her eldest daughter continued to live here and maintain paying taxes and fees.
In addition, Ms. Anh asked the court to cancel the legal validity of the will that Duc Tien made in the US on August 9, 2023 (according to Binh Phuong, this will contains the content of leaving property to his wif.e), on the grounds that it is invalid in Vietnam.
Since then, Duc Tien's mothe.r asked the court to determine that the house in Thu Duc is the common property of her and her son, so she received 50%.
In case the court does not recognize the co-owner of the house in Thu Duc, Ms. Anh cited Case Law No. 05/2016 on contributions in heritage management and embellishment, wanting to enjoy 20% of the value of the house, the remaining 80% divided equally among the inheritances, she also gets a part.
In the counterclaim, Ms. Anh presented her difficult situation, hoping to receive the house and pay cash to her daughter-in-law and grandson.
Regarding the land in Long An, which is the common property of Duc Tien and Binh Phuong, Ms. Anh asked to receive a part of 50% of her son's inheritance.
