Ms. Truong My Lan clarifies the source of 6,000 billion transferred to Tuan Chau Group?

In the afternoon session of November 22, Ms. Truong My Lan asked the court to present additional arguments related to the appeals of two companies, Au Lac and T&H Ha Long (belonging to Tuan Chau Group).

Ms. Lan said she had worked with Mr. Dao Hong Tuyen, Chairman of the Board of Directors of Tuan Chau Quang Ninh Group (also known as "Lord of Tuan Chau Island") since 2016 and had transferred to Dao Anh Tuan (Mr. Tuyen's son) and two companies more than 6,095 billion VND to carry out cooperation agreements since 2016.

This amount of money was not related to SCB but her money. At that time, Ms. Lan called on about 60 foreign investors to cooperate with Tuan Chau, hired foreign consultants and architects to research and design projects in Tuan Chau ward, Ha Long city, Quang Ninh province, with the desire to turn this area into "Dubai-like" projects.

According to Ms. Lan, in order to attract foreign investors, over the years, the defendant has used Van Thinh Phat's money and money borrowed from friends. "The defendant affirms that more than 6,000 billion VND transferred to Tuan Chau Group belongs to the defendant, not to SCB. If SCB wants to say that 6,000 billion VND belongs to them, they must have evidence. As for the assets of the two companies T&H Ha Long and Au Lac Quang Ninh that are being mortgaged to SCB, they were lent to SCB by Mr. Dao Anh Tuan out of gratitude to the defendant to restructure the bank," Ms. Lan said in court.

According to Ms. Lan, about 2 months before being arrested, Mr. Tuan called her to ask for the red books back. The defendant said that when Tuan Chau paid more than 6,000 billion VND, SCB must return the documents and requested the People's Procuracy and the People's Court to take measures to resolve the issue for the related parties. If it is delayed for a long time, it will lead to many consequences that cannot be resolved.

Regarding the amount of money transferred to Tuan Chau, according to the first instance judgment, defendant Lan directed his subordinates to transfer VND 3,179 billion to Mr. Tuan according to the framework agreement dated December 20, 2021.

In addition, Au Lac Company and T&H Ha Long received 2,916 billion VND from 5 companies under Van Thinh Phat Group (Sunny World Company, Van Phat Company, Hung Phuc Company, Vinh Thinh Phat Company, Hai Ha Company) according to 5 deposit agreements, transferring part of the Morning Star villa project (243 townhouses) and Hoang Long villa project with a total value of 5,068 billion VND. That means Ms. Lan still has to pay these two companies more than 2,152 billion VND to own 243 townhouses, belonging to the Morning Star villa project and Hoang Long villa project.

The court of first instance determined that more than VND6,095 billion originated from SCB, so the two companies were forced to return it to ensure that the consequences of the case were remedied. Regarding the assets the two companies used to secure loans at SCB, the police investigation agency prevented the transfer transaction, and the court separated them so that these legal entities could resolve the case with SCB and related parties when requested by the parties.

Also in the afternoon of November 22, defendant Lan sent the panel of judges a set of documents and presented the figures stated in them. According to Ms. Lan, these documents are valuable in proving that the accusation that she embezzled money and thus classified it as embezzlement is incorrect, there is overlap between the period before and after January 1, 2018.

However, Ms. Lan's presentation with many unclear figures, so the panel of judges gave her two more days over the weekend to work with a lawyer or let her lawyer present on her behalf in the working session on November 25.

The panel of judges said that in order to create conditions for the lawyers and Ms. Lan to have time to work together to clarify the numbers in the newly provided documents, on the next working day, the panel of judges will allow the lawyers of the other defendants to debate first with the People's Procuracy.

After listening to the parties' presentations, the panel of judges announced that to ensure the continuity of the civil debate, the representative of the People's Procuracy would begin the debate on the next working day.
