Previously, NewJeans announced that they were ending their relationship with ADOR management company. They hope to operate freely and not be controlled by this company.
Previously, regarding the issue of the group name after leaving ADOR, NewJeans was also discussed by a lawyer. Specifically, in a video posted on YouTube, Lawyer Lee Ji Hoon analyzed the incident and revealed his thoughts on the group name, he said: "If they continue to operate, they need to change their name first. They should not use that name. NewJeans stated that they have legally notified ADOR of the termination based on the contract. After that, the copyright, trademark and intellectual property rights in the contract belong to ADOR.
This means they have to return the NewJeans name. At the very least, they have to be consistent with their claims. If they continue to use the name, they could be liable for damages.
However, this also means that they will have to take legal action to get the name back. We also need to look at the contract to see if they can continue to operate. That way, the risk will be less."
He also felt that NewJeans' complaints were not enough to terminate the contract: "Given the different interpretations of what conduct interfered with their operations, it is difficult to say that the contract has been terminated. If the complaints about interference with their operations are the six requests that NewJeans has submitted, in my opinion, it is difficult to consider that as a termination of the contract. Although they claim that the contract has been terminated, I do not think so."
Lawyer Lee Ji Hoon also added to the story of NewJeans stating that they had no intention of paying the termination fee in the previous press conference. He said: "But they have to pay. It would be difficult for society to accept if they create a situation where they have to pay and say they have no intention of paying. Even though they don't want to pay a penny, they will have to pay. This is the legal risk of the group."
NewJeans' departure from ADOR has also caused quite a bit of controversy. In a new statement released on December 13 (Korean time), the Korea Music Content Association condemned the controversial behavior of the music industry and advised the members of NewJeans to return to ADOR to fulfill their responsibilities as stated in their exclusive contracts.
"NewJeans must make every effort to fulfill its responsibilities under the exclusive contract and consult with the management company with the goal of resolving the issue through dialogue.
