The information was given by Major General Nguyen Thanh Tung, Deputy Director of Hanoi City Police, at the press conference on the first quarter socio-economic situation of the City People's Committee, on the afternoon of March 28.

Regarding the case of customers losing 58 billion VND at MSB (Vietnam Maritime Commercial Joint Stock Bank) that occurred at the end of 2023, Mr. Tung said that on October 10, 2023, the Security Investigation Agency of Hanoi City Police received received news from MSB Bank about the discovery that the above bank employee showed signs of appropriating assets.

Accordingly, the information accuses Ms. BTHA (born 1984, residing at apartment 390 Bo De, Long Bien), who is the Director of MSB Bank Thanh Xuan branch, of having signs of defrauding customers of their assets in the amount of 165 VND. billions dong.

Based on the investigation results on October 18, 2023, the Deputy Director of Hanoi City Police said that the investigation agency has prosecuted the case and temporarily detained Ms. BTHA. Initially, the functional unit determined that Ms. appropriated the property of 8 victims for the amount of 338 billion VND.

"The police have applied measures to recover assets to pay the victims. Initially, it was determined that there were no accomplices and the police are continuing to exploit and expand. To date, no victims have come forward to report anything other than The eight victims above came to report," Mr. Tung said.

Hanoi Police leaders also called on any victims related to the above incident to contact the authorities to be received and resolved according to regulations.

Regarding the case of many customers claiming to have lost tens of billions of dong deposited at Vietnam Maritime Commercial Joint Stock Bank (MSB), lawyer Tran Tuan Anh - Director of Minh Bach Law Company, Hanoi Bar Association - said that in case customers can prove that they have paid money to MSB, then the customer is the related person.

Meanwhile, bank officials used deceitful tricks to withdraw money from customers, MSB bank was the victim of this person. This officer must have the obligation to reimburse MSB bank and MSB is responsible for returning that amount to the customer.

"In this case, if the investigation agency determines that an MSB officer deceived the bank to withdraw money from the customer's account deposited here, MSB, as the victim, has the right to request this person to refund the amount defrauded.

At the same time, the bank is responsible for returning the money to the customer because the bank has accounted for the amount the customer deposited into the account. As for the officials' violations, as long as the money is returned to the bank, customers don't need to worry."

Accordingly, Mr. Tuan Anh said that harmed customers related to MSB still have a chance to get their money back.

Sharing the same opinion, another lawyer said that according to the provisions of Point g, Clause 2 (payment service providers have obligations), Article 6, the rights and obligations of payment service providers, Circular number: 15/VBHN-NHNN dated December 28, 2020 stipulates "Service providing organizations are responsible for damages due to errors or being taken advantage of or deceived on customers' accounts due to their own errors" .

Customers sign a contract to open a payment account and are granted a payment account code by MSB Bank. After each deposit into the account, the bank's leaders sign to confirm the information and stamp the bank's seal.

From there, it can be determined that the transaction of depositing and transferring money to the customer's account opened at MSB is a monetary transaction between the customer and the bank, so it is not a person-to-person transaction. Therefore, if any risk occurs related to depositing money into this bank account, the responsibility belongs to MSB.
