In case of arbitrarily rewriting without the consent of the copyright owner or author, it is an act of copyright infringement as prescribed in Clause 7, Article 28 of the Intellectual Property Law.

The second case is that when the song has expired, people have the right to use the work without having to ask for permission or pay remuneration or royalties to the owner.

The copyright protection period for a song as prescribed at Point b, Clause 2, Article 27 of the Intellectual Property Law is during the author's lifetime and 50 years after the author's death. In the case of a song with multiple co-authors, the probation period will end in the 50th year after the death of the last co-author.

Thus, in this case, the author of the song "The sad part of the rainy night" is the famous singer Che Linh, who is currently alive, anyone who rewrites the lyrics to form a derivative work must ask for his permission and pay remuneration in accordance with the law.
