Vu Linh attacked Hong Loan's niece, owning 15% of the house?

On January 7, the Ho Chi Minh City People's Court opened the first instance trial of the inheritance dispute and claim for a house to live in between the plaintiff Vo Thi Hong Nhung, 61 years old, and the defendant Vo Thi Hong Loan, 38 years old (daughter of the late artist Vu Linh).

In court and in the lawsuit, the plaintiff argued that Ms. Hong Loan had evaded her obligation to support her father, so she requested to be deprived of her inheritance rights. Specifically, the plaintiff argued that Ms. Hong Loan had a husband and had not lived with Mr. Vo Van Ngoan (aka the late artist Vu Linh) for a long time, and that when he was sick, Ms. Hong Loan did not support him.

Responding to the court's questions on the above issue, Ms. Hong Loan said that during the process of returning to her husband's house, she often visited her father and there were no conflicts between father and son.

"When my father was hospitalized, I was there, but Ms. Nga (manager of the late artist Vu Linh - PV) said the hospital wouldn't let me go because I needed a visiting card, but no matter how late it was, I still went to the hospital wanting to take care of my father," Hong Loan said.

The court determined that Ms. Hong Loan not living in the same house with Mr. Ngoan was an adult chil.d's right to choose where to live. Therefore, there was no basis to show that Ms. Hong Loan was avoiding or refusing her obligation to support her father.

According to the court, to determine a serious violation of the obligation to support leading to loss of inheritance rights, there must be a legally effective judgment clearly defining the obligation to support. When the obligated person fails to fulfill the obligation to support and the person leaving the inheritance is in difficult circumstances, with life-threatening circumstances, the act of failing to fulfill the obligation to support is considered a serious violation.

In this case, Mr. Ngoan is able to take care of himself, has the finances to hire a maid and enough assets to support himself.

On the contrary, Ms. Hong Loan is facing financial difficulties and has borrowed mone.y from Mr. Ngoan but has not been able to pay it back. Ms. Loan’s husband was also hired by Mr. Ngoan as a driver. This shows that Ms. Hong Loan is not financially capable, and there is no evidence that she intentionally refused to pay alimony.

Furthermore, there is no basis to prove that Mr. Ngoan was in a dangerous or miserable situation that required support from Ms. Hong Loan. Therefore, the plaintiff's request to deprive Ms. Hong Loan of her inheritance rights is unfounded.

After 1 day of trial, Ho Chi Minh City People's Court declared that Ms. Vo Thi Hong Loan is the legal chil.d of the late Meritorious Artist Vu Linh, so she is the first and only heir to inherit 85% of the assets, and considering Ms. Hong Nhung's efforts, 15% of the inheritance is recognized.

Lawyer Le Van Hoan (Ho Chi Minh City Bar Association) said that according to the verdict, the court determined that Ms. Nhung's contribution was 15% of Mr. Vo Van Ngoan's inheritance, which is 15% of the total value of 2 real estates (house and land at 5 Doan Thi Diem and a 3,007m2 plot of land in Thu Duc City) and 1 car.

Although the house and land at 5 Doan Thi Diem (Phu Nhuan district) has been transferred to Ms. Hong Loan, this property is Mr. Ngoan's inheritance so it still has to be divided (according to the recently announced verdict, Ms. Nhung will be divided 15% of the house value, and Ms. Loan will be divided 85% of the house value).

However, according to lawyer Hoan, the court's statement "If after the above time, Ms. Loan is unable to repay Ms. Nhung, one of the parties has the right to request the competent enforcement agency to auction off the entire land use rights of 3,007 square meters and the car to enforce the judgment" is not accurate.

Because the court cannot specify which assets to auction and the law does not stipulate which assets must be auctioned to enforce the judgment, the enforcement agency will seize and auction assets with a value corresponding to the obligation to execute the judgment.
