The High Court in Ho Chi Minh City is scheduled to open an appeal hearing on May 10 to consider the appeal of Mr. Nguyen Duc An and Pham Thi Ngoc Thuy (44 years old, supermodel Ngoc Thuy) about the dispute over assets of about VND 280 billion after the divorce.

The first instance verdict of Ho Chi Minh City determined that Mr. An registered his marriage with Ngoc Thuy in the US in 2006 and has two children together. In March 2008, the couple divorced in California state court. In 2010, Mr. An filed a lawsuit asking his ex-wife to return 39 types of properties purchased in Vietnam, including stocks, cars, dozens of apartments, land plots, villas in large projects in Ho Chi Minh City and Phan Thiet (such as Avalon Building, Sailing Tower, Sea Links Golf & County Club). for claiming that the property was "purchased with own money acquired before marrying Ngoc Thuy". During the time they were husband and wife, because he was an American citizen, he had to ask his wife to own it.

Therefore, for assets including about 30 properties in many localities and shares in companies, Mr. Duc An's side asked the court to hand over the name to 2 daughters with Ngoc Thuy.

Meanwhile, Ngoc Thuy's side disagreed, saying that this is a common property during the marriage, so she proposed to divide it in two. Ngoc Thuy also wants to receive the property, which will pay 50% of the value to Mr. An.

In November last year, after 13 years of handling and settling the lawsuit, HCMC determined that the disputed property was the "joint property during the marriage" of the spouses, not the plaintiff's separate property before the marriage.

The Construction Council partially accepted Mr. An's request and also Thuy's, dividing the value of 15 properties in half with the parties including: 5 apartments in Avalon Building (District 1); 4 apartments in Sailing Building (District 1); villas in Binh Thanh district; Binh Minh Company Limited; 465,000 shares in Sao Mai Port Company; the amount returned by the landowner in District 2, the amount of compensation for the house 95A Tran Phu (Vung Tau); The rental amount of 9 apartments in District 1 from 2009 to 2023.

For 13 villas in the Sealing project, the court did not accept the parties' request for division, because 4 units Thuy sold during the marriage, 4 units sold after divorce to buy other assets. These units are now gone, so there are no grounds for granting the plaintiff's claim for division of the property. With the remaining 5 units (in the name of Mrs. Be - Thuy's mother), the defendant said that her mother had authorized the plaintiff to sell but he denied. These units are also now gone, so the court has no grounds for division.

As to the plaintiff's other claim to recover certain sums of money and other property, the court did not accept it as it held that there were no grounds. Disagreeing with this ruling, Mr. An appealed the entire judgment of first instance, disagreeing with the court's bifurcation of the disputed properties with the defendant.

He contended that the judgment of first instance dividing the property in half between the defendant was not satisfactory to him, contrary to the facts of the case, contrary to the provisions of law. The plaintiff asked the High Court in Ho Chi Minh City to hear the appeal in a "objective manner, in accordance with the provisions of law" to protect his legitimate rights and interests.

Ngoc Thuy said that the trial court's rejection of her request to force Duc An to divide 5 villas in Phan Thiet is "not in accordance with objective reality". She appealed, asking the High Court in Ho Chi Minh City to hear the appeal, partially amend the first instance judgment in favor of accepting her counterclaim, recognizing the above five properties as common property during the marriage period and forcing Mr. An to refund 50% of the value equivalent to more than VND 8.7 billion.
