According to the appeal, Ms. Thuy requested the Court of Appeal to consider and partially amend the judgment in the direction of: Accepting the defendant's counterclaim regarding the request to recognize the property value of the 5 S41 villas. , S42, S43, S60, S61 in Phan Thiet City, Binh Thuan Province are common property, created during the marriage of the plaintiff and defendant. Request the plaintiff to refund 50% of the value of the above 5 villas, which is 8.7 billion VND.

However, the first instance court said that there was no basis to determine that the plaintiff received money from the sale of these 5 villas, so it did not accept Ms. Thuy's request to divide assets. The first instance court also awarded Mr. Duc An ownership of Binh Minh Company Limited (including the right to use more than 3,700 m2 of the company's land in Ba Ria - Vung Tau), paying Ms. Thuy more than 43.5 billion VND.

The assets include 5 apartments at the Avalon building in District 1 (estimated at more than 45 billion VND); 4 apartments at Sailing building, District 1 (estimated at more than 37 billion VND); Villa N4 N5 Binh Thanh District (estimated at more than 5 billion VND); Binh Minh Company Limited (more than 86 billion VND); 465,000 shares at Sao Mai Port Company (more than 2.3 billion VND); The amount of money returned by Mr. Do Khac Binh, the compensation amount for the house 95A Tran Phu, Vung Tau City (more than 596 million VND); Rental amount of 9 apartments in District 1 from 2009 - 2023 (more than 7.8 billion VND).

In 2010, Mr. An filed a lawsuit with the People's Court of Ho Chi Minh City, asking Ms. Thuy to return 39 properties that, according to Mr. An, during the time he was living with Ms. Thuy, he was an American citizen, so he asked his wife to own them. 39 types of assets he bought in Vietnam (including stocks, cars, apartments, plots of land, villas in large projects in Ho Chi Minh City and Binh Thuan...).

In 2017, Ms. Thuy's side filed a counterclaim, submitted to the People's Court of Ho Chi Minh City, requesting to be divided 50% of the value of assets formed during the marriage, worth more than 39 billion VND.

According to the content of the first instance judgment, regarding the plaintiff's lawsuit request and the origin of assets, there is only evidence to determine that Mr. An sent 2 sums of 47 billion VND and 700,000 USD to Ms. Thuy. The plaintiff presented the remaining amount in cash to the defendant to buy property, but the defendant did not admit it, so there was no basis for determination.

The first instance judgment also said that the money that Mr. An sent to Ms. Thuy was common property during the marriage, there was no basis to determine that the disputed property was the plaintiff's personal property, and other money Mr. An could not provide evidence to prove that he sent this money to Ms. Thuy.
