The District 10 People's Court said it had issued a notice on the implementation of the decision to execute the prison sentence for Trang Nemo. Yesterday (February 26), Trang Nemo also received a notice.
Previously, at the appeal trial in September 2023, the People's Court of Ho Chi Minh City upheld the first instance sentence of nine months in prison for defendant Trang Nemo for disturbing public order. According to records, Trang Nemo's current residence is on Thanh Thai Street, Ward 14, District 10. Therefore, the People's Court of District 1 has entrusted the People's Court of District 10 to carry out the procedures and issue a decision to execute the judgment.
From September 2023 to now (February 27, 2024) - it has been nearly six months but Trang Nemo has still not served his nine-month prison sentence. According to developments, the People's Court of District 10 reported as follows:
On November 8, 2023, Trang Nemo applied to postpone the prison sentence for the reason that he is the only worker in the family.
On January 23, 2024, the Chief Judge of the District 10 People's Court announced a response not to accept the application to postpone the prison sentence of convicted person Trang Nemo.
On January 26, 2024, Trang Nemo filed a complaint with the Ho Chi Minh City People's Court against the announcement of the Chief Judge of District 10 about not accepting the application to postpone the prison sentence.
On February 20, 2024, the People's Court of Ho Chi Minh City issued a written response not accepting Trang Nemo's complaint and upholding the announcement of the Chief Judge of District 10 People's Court.
On February 23, 2024, the People's Court of District 10 issued a notice on the implementation of the decision to execute the prison sentence for Trang Nemo.
On February 26, 2024, Trang Nemo received notice of the execution of the decision to execute the prison sentence.
At the appeal trial in September 2023, the People's Court of Ho Chi Minh City rejected the appeal of the defendants and people with related rights and obligations and affirmed the first instance verdict of defendants Trang, Pham Quyen Quy, and Nguyen Ngoc Khuong (same level). nine months in prison) and defendant Phan Hoang Nam (one year in prison), both on the charge of disturbing public order.
At the trial, Trang Nemo defended herself because she did not have a lawyer and asked for a suspended sentence because she was raising young children, her parents were sick, and her family had someone with meritorious service to the revolution. Trang Nemo's case stems from a conflict over online sales with Ms. Tran Nguyen Tra My. The couple arranged to meet at Trang Nemo's store in District 1. At around 2:45 p.m. on January 16, 2022, Tra My, Ms. Pham Le Khanh and Tran Hoang Yen came to Trang Nemo's store to talk. Here, My and Yen went into the store to meet Trang to apologize, while Khanh stood outside.
At about 3:00 p.m. on the same day, while My was apologizing, Khanh entered the store and asked the two girls to leave and an argument broke out with Trang Nemo. During the argument, a fight broke out between both sides, and many people at the store joined in beating Khanh.
The incident was livestreamed on social networks, causing a stir in public opinion, and at the same time causing insecurity and disorder on the street in front of Trang Nemo's store in District 1, the authorities had to come and disperse the crowd. Ms. Pham Le Khanh then sued Trang Nemo and her accomplices to court for injuring her.
At the first instance trial, Ms. Pham Le Khanh proposed to prosecute Trang Nemo and his accomplices for the additional crime of intentionally causing injury. However, at the appeal hearing, the Trial Council said that the crime the defendants were prosecuted for was disturbing public order, and Ms. Pham Le Khanh's request was outside the scope of the case. If you do not agree with the results, you can continue to complain to the investigation agency. At the same time, the Trial Council said that the defendants were at fault, but Ms. Pham Le Khanh also had inappropriate words and behavior at that time.
