On the afternoon of March 14, at 12 Ly Dao Thanh (Trang Tien Ward, Hoan Kiem District, Hanoi City), Chi Em Rot Group Joint Stock Company (CER Company) organized a "Friendly meeting with CER Group Team and Media".

Immediately afterwards, the Hanoi Department of Culture and Sports confirmed that this unit had not yet approved the Chi Em Rot Group Joint Stock Company (CER Company) to hold a press conference in Hanoi on the same afternoon.

Therefore, the Department of Culture and Sports of Hanoi city said that the unit, together with the People's Committee of Hoan Kiem district, the People's Committee of Trang Tien ward and the Trang Tien ward police, has drawn up a record of the incident and will continue to coordinate with relevant agencies to review, clarify and provide information to the press.

Discussing this issue, Dr. and lawyer Dang Van Cuong (Chinh Phap Law Office) said that when the incident related to the reflection of violations of commercial business, violations of advertising, signs of consumer deception are being verified by the authorities, and there is no conclusion yet, holding a press conference is inappropriate, can affect public opinion and affect the process of verifying the incident.

Therefore, lawyer Cuong affirmed that the authorities' refusal to grant a press conference permit to the unit being inspected is well-founded.

"However, if the organization of a "meeting" in the form of a "friendly meeting", "sweet meeting", "public meeting" or any other form of meeting with press agencies to inform about the incident, answer questions, clarify related issues but in essence is a "press conference", this act is still determined to be a violation of an "underground" press conference and the violator will be handled", said lawyer Cuong.

Further analyzing the above incident, lawyer Dang Van Cuong said that the meeting between CER Company and the press agency was to provide information on issues that the authorities were verifying and that the public was interested in. The press agency might publish this information in newspapers.

Meanwhile, any activity of contacting and providing information to the press without permission from the competent authority, regardless of whether the meeting is called a "press conference", "meeting", "gathering" or any other name, is a violation of the law.

"In theory, form expresses content and content determines form. How the content is expressed in this meeting, who is the subject of the meeting, the information of the meeting and how it takes place will decide whether this meeting is called a press conference or not, regardless of its name.

In essence, changing the form does not change the content, so no matter what the name is, if the content is a press conference, it is still a press conference. If there is no permission from the authorities, this is an illegal press conference and will be handled," the lawyer added.

How can "changing the name" of a press conference to avoid having to ask for permission be handled?

Lawyer Dang Van Cuong emphasized that press conferences are a form of press information regulated in the 2016 Press Law, which means they must be managed by state agencies.

If an agency, organization or individual arbitrarily organizes a press conference and "changes the name" of the press conference to another name to avoid having to ask for permission, but the content and nature are still "press conferences" without permission from the authorities, this act is still a violation of the law and will be subject to administrative penalties.

Lawyer Cuong said that individuals and organizations that violate regulations on press conferences will be fined, the lowest fine is 1,000,000 VND, the highest fine can be up to 200,000,000 VND according to the provisions of Article 11 of Decree 119/2020/ND-CP.

It is known that at this friendly meeting, Quang Linh also announced that he will retire and will not livestream to sell products for a long time. He will return to Angola to continue his unfinished work.
