At the same time, Dong Bac Hai Duong Co., Ltd. is the unit that buys all coal output from Yen Phuoc Company's mine, with negotiable prices according to different types of coal.

According to the dossier, Dong Bac Hai Duong Co., Ltd. was granted a business registration license by Hai Duong Department of Planning and Investment for the first time in 2017 with a charter capital of VND 5 billion, so far this business has changed 6 times. Business license. The legal representative of the company from June 1, 2017 to August 30, 2019 is Mr. Ha Anh Tuan, the title of director; The legal representative of the company from August 30, 2019 to present is Mr. Bui Manh Cuong, the title of director.

During its operation, Dong Bac Hai Duong Co., Ltd.'s main activity is to buy coal from Vietnam Coal - Mineral Group and Song Hong Coal Joint Stock Company, then process coal (mix coal according to the requirements of the company's quotas). customers) supplied to Xuan Thanh Cement Factory in Ninh Binh and Hoang Thach Cement Factory in Hai Duong.

By the end of 2017 and 2018, Dong Bac Hai Duong Co., Ltd. moved into a big business with the capital contribution of two brothers, Bui Huu Thanh and Bui Huu Giang, in Dong Trieu Town, Quang Ninh. The process of increasing capital of Dong Bac Hai Duong Co., Ltd. recorded the capital contribution of Bui Huu Thanh with 48 billion dong, Bui Huu Giang 70 billion dong, accounting for nearly 70% of contributed capital in this enterprise.

Bui Huu Thanh and Bui Huu Giang did not directly participate in operating activities at Northeast Hai Duong Co., Ltd., but appointed Bui Manh Cuong, driver of Vu Thi Hieu (Bui Huu Thanh's wife) as director and participated in other activities. activities of the company, and at the same time appoint many trusted people to participate in the activities of the company.

From March 2019 to August 2021, Dong Bac Hai Duong Co., Ltd. directly carried out the mining under the direction and supervision of employees of Yen Phuoc Joint Stock Company, with an output of about 2.5 million tons of raw coal, folded. many times volume 8,500 tons/year under license.

In order to legalize this illegally exploited coal, the subjects in the line, including legal entities Yen Phuoc Joint Stock Company and Dong Bac Hai Duong Co., Ltd., used false contracts, acceptance minutes. confirm the volume of mining, unloading, the quantity of raw coal (not yet selected and processed) exploited with a much lower quantity than the reality, ranging from 900 to 1,400 tons/month to be suitable. with the mining capacity according to the above-mentioned short-term contract and the licensed capacity.

In fact, Yen Phuoc Joint Stock Company only paid the fee for granting the right to exploit minerals of all kinds with a total of 2.8 billion VND. C03 determined that illegal coal mining and consumption in this line helped brothers Bui Huu Thanh, Bui Huu Giang and other subjects illegally benefited hundreds of billions of dong.
