The defendant's defense attorney argued that Ms. Vo Thi Hong Loan had testimon.y and documents proving that Ms. Loan was the only chil.d of Mr. Vo Van Ngoan, so the defendant requested to suspend Ms. Hong Nhung's lawsuit because Ms. Nhung did not have the right to sue; requested Ms. Nhung and Ms. Le Thi Hong Phuong to move all assets out of the house at 5 Doan Thi Diem where both of them were staying.

Responding to the lawyer's question, Ms. Loan said that her birth certificate only identified her as the legal chil.d of Mr. Vo Van Ngoan.

During their lives together, Mr. Ngoan never said that she was his adopted daughter. When Ms. Loan was young, Mr. Ngoan took care of her. There was no conflict between her and Mr. Ngoan. At the ag.e of 17, she got married but still went to Mr. Ngoan's house.

Next, the lawyer asked Ms. Vo Thi Hong Nhung. Ms. Nhung said that in 1987, Ms. Loan was brought back to her family to raise. After her mother passed away, her family raised Ms. Loan.

"According to the adoption certificate and birth certificate, my brother recognized Hong Loan as his chil.d. I confirm that my brother never made any paperwork for Hong Loan. The reason is that at that time my brother was very famous and sang a lot so he did not make any paperwork.

The People's Committee headquarters is only 15 meters away. If my brother takes the initiative to adopt her, he must take the initiative to do the paperwork. The time to do the paperwork is Saturday and Sunday, my brother is very busy," Ms. Nhung explained.

Ms. Nhung said Mr. Ngoan was upset about Ms. Hong Loan and decided to kick her out of the house. She has always been the one to protect Hong Loan. As for the reason why she filed the lawsuit, Ms. Nhung said that all the documents were illegal. Mr. Ngoan did not have a first-line heir, so she and her brother, Mr. Vo Van Nhieu, were the second-line heirs.

"My family and I have taken care of Ms. Hong Loan for many years, but Ms. Hong Loan behaved very cruelly and kicked me out of the house, so I had to seek legal protection," Ms. Nhung said, crying.

The representative of the People's Procuracy stated that the adoption and birth registration of Ms. Hong Loan were carried out in accordance with the law. In addition, the household registration shows that the defendant is Mr. Vu Linh's chil.d. In addition, the case file shows that the late artist Vu Linh was not married, lived alone, and had no parents, so Ms. Hong Loan was the sole heir. Therefore, the People's Court requested that the entire lawsuit of Ms. Nhung be dismissed.

However, in this case, Ms. Hong Loan is the first-line heir and has not been deprived of her rights, so the plaintiff's request is unfounded. Therefore, the defendant is the one who is entitled to the entire estate left by the late artist Vu Linh.

Due to Ms. Nhung's circumstances and considering her contribution, the panel decided to give the plaintiff 15% of the late artist Vu Linh's assets. Ms. Loan is obliged to return 15% of the assets to the plaintiff.
