Believing that Ms. Vo Thi Hong Loan is not the legal adopted chil.d of artist Vu Linh, Ms. Vo Thi Hong Nhung appealed to reclaim all of her brother's assets. In addition, Vu Linh also mentioned a shocking piece of information related to Hong Loan's motive.
Ms. Vu Thi Hong Nhung - the younger sister of the late Meritorious Artist Vu Linh - filed a partial appeal against the first instance verdict in the case of "Dispute over inheritance of property, requesting to cancel the case and demand a house for temporary residence". At the beginning of the appeal, Ms. Nhung affirmed that the family wanted to stop the case so that her brother could rest in peace, even though the requests had not been satisfactorily resolved.
However, Ms. Vo Thi Hong Loan - adopted daughter of the late Meritorious Artist Vu Linh - has filed an appeal and announced on the media and social networks that she will not give the family a single penny.
"Ms. Loan believes that she is the legitimate chil.d, has the right to receive 100% of Mr. Vo Van Ngoan's assets and would rather take 15% for charity than leave that amount of assets to our family. Truly, those are unjust words to us" - Ms. Nhung indignantly wrote in the petition.
Ms. Nhung said that the first instance judgment determining that Ms. Vo Thi Hong Loan was the first and only heir of artist Vu Linh, thereby determining that she was entitled to 85% of the inheritance value, was "not consistent with the objective circumstances of the case".
According to Ms. Nhung, Ms. Loan is not a legally adopted chil.d because artist Vu Linh did not register for adoption; the adoption papers and birth certificates issued by the People's Committee of Phu Nhuan District are not in accordance with regulations.
Ms. Nhung also said that Ms. Loan was not adopted by her brother at first, but was brought to her mother by an acquaintance. After her mother passed away, artist Vu Linh and his family continued to raise Ms. Loan until she became an adult.
In terms of procedures, the household registration register states that Ms. Loan is the chil.d of artist Vu Linh. However, according to Ms. Nhung, these are only necessary procedures for Ms. Loan to have the conditions to live and study. Artist Vu Linh's sister affirmed that Ms. Loan was not registered as an adopted chil.d by the artist according to regulations, so she is not his legal adopted chil.d.
Also in the petition, Ms. Nhung stated that when artist Vu Linh passed away, she, her daughter, and his relatives and friends arranged a thoughtful and solemn funeral. Ms. Loan did not contribute or take care of the artist's funeral, but only took the opportunity to complete inheritance procedures and transfer the property.
Ms. Nhung also said that Ms. Loan and some other people fabricated untrue stories, causing many people across the country and overseas to misunderstand, blame, and insul.t her family.
Regarding the house at 5 Doan Thi Diem (Phu Nhuan District), according to Ms. Nhung, this property was given by artist Vu Linh to Le Thi Hong Phuong - Ms. Nhung's daughter - through a verbal contract. Until his deat.h, the artist did not change his mind, so it is no longer his legacy.
Based on the above, Ms. Nhung concluded that Ms. Loan was not the legally adopted chil.d of artist Vu Linh and was not eligible to receive his inheritance. In the last years of his life, when he learned that he was seriously ill, artist Vu Linh chose Ms. Nhung and Phuong to live with him to share; giving Phuong a house to live in as well as a place of worship.
From there, Ms. Nhung requested the appellate court to amend the first instance judgment, accept her lawsuit and reject all of Ms. Loan's counterclaims; request the appellate court to cancel the adoption papers, birth certificates, and inheritance declaration documents of Ms. Loan; determine that the house and land at 5 Doan Thi Diem were given to Ms. Phuong; determine that artist Vu Linh has no heirs in the first order of inheritance, the heirs in the second order of inheritance including Ms. Nhung and Mr. Vo Thanh Nhieu are entitled to inherit the entire estate of the late artist; force Ms. Loan and related people to move out of house at 5 Doan Thi Diem and hand over this house and land to Le Thi Hong Phuong.
Ms. Nhung also requested to cancel the inheritance declaration that Ms. Vo Thi Hong Loan declared regarding the assets including: land use rights for plots 87 and 88 in Linh Dong ward, Thu Duc district (now Thu Duc city); cars.
Previously, on January 17, Ms. Hong Loan filed an appeal, requesting the appellate court to amend the first instance judgment not allowing Ms. Hong Nhung to receive 15% of the inheritance.
