Returning to the housing dispute lawsuit, recently, the Ho Chi Minh City People's Court announced that it will open a trial for the inheritance dispute between the plaintiff, Ms. Vo Thi Hong Nhung, and the defendant, Ms. Vo Thi Hong Loan, on December 16.
Cause of dispute
The late Meritorious Artist Vu Linh, once known as the "king of Cantonese opera", passed away on March 5, 2023, leaving behind many valuable real estates. After his death, conflicts arose among family members regarding the division of inheritance.
In early June 2023, Ms. Vo Thi Hong Nhung, the late artist's younger sister, filed a lawsuit with the People's Court of Phu Nhuan District, Ho Chi Minh City, requesting the court to adjudicate. The plaintiff argued that all of Mr. Vu Linh's assets could not be owned by Ms. Vo Thi Hong Loan - who is said to be his only daughter.
On the contrary, Ms. Hong Loan affirmed that she is the legal biological child of Meritorious Artist Vu Linh and is the first heir according to the law.
By March 2024, after a period of acceptance, the People's Court of Phu Nhuan District transferred the file of this inheritance dispute to the People's Court of Ho Chi Minh City. The reason for transferring this file was determined to be because the plaintiff - Ms. Vo Thi Hong Nhung - had specific requests, including: Canceling the adoption handover certificate and canceling the birth certificate of the defendant - Ms. Vo Thi Hong Loan.
Claim of Plaintiff Vo Thi Hong Nhung
As the plaintiff, Ms. Vo Thi Hong Nhung has made a series of requests, including: Cancel the inheritance declaration document that Ms. Vo Thi Hong Loan made on April 7, 2023.
This document identifies Ms. Hong Loan as the heir to all assets of the late artist Vu Linh, including: House and land use rights at No. 5 Doan Thi Diem, Phu Nhuan District; land use rights for two plots of land No. 87 and 88 in Linh Dong Ward, Thu Duc City; a car.
In addition, Ms. Hong Nhung requested to cancel the updated changes on the land use rights certificate at No. 5 Doan Thi Diem and requested to verify the signature of artist Vu Linh on related documents.
In particular, Ms. Hong Nhung requested the court to determine that the entire estate of Meritorious Artist Vu Linh belongs to the second line of heirs, including her and Mr. Vo Thanh Nhieu - the late artist's younger brother. She also requested that the people residing at house number 5 Doan Thi Diem return this property to her and Mr. Nhieu.
Counterclaim of defendant Vo Thi Hong Loan
In response to the plaintiffâs requests, the defendant, Ms. Vo Thi Hong Loan, firmly objected. Ms. Hong Loan asserted that she was the legitimate biological child and sole heir of the late artist Vu Linh. To prove this, she submitted documents, including a birth certificate and other legal papers.
According to Ms. Hong Loan, Ms. Hong Nhung's claim that there is no first-line heir is unfounded. She also emphasized that she has lived with the late artist's family since 1987 and has always been recognized as his daughter.
In addition, Ms. Hong Loan also filed a counterclaim, asking the court to force Ms. Vo Thi Hong Nhung and Ms. Le Thi Hong Phuong (another family member) to leave house number 5 Doan Thi Diem.
Unsuccessful reconciliation
Before the case was brought to trial, the Ho Chi Minh City People's Court held meetings for the parties to examine, access and disclose evidence, and conduct mediation.
The final conciliation session took place on November 14, but the parties failed to reach an agreement. The defendant requested the court to continue to resolve the case in accordance with legal procedures and affirmed that it would respect the opinions of the prosecution agencies, and would not make any further requests.
At the request of the Ho Chi Minh City People's Court, the Institute of Criminal Science has conducted a signature appraisal on documents related to the adoption of children. The appraisal documents include the house purchase and sale documents, the notice of change of permanent residence and the personal file requesting consideration for the award of the title (photocopy).
The results of the examination showed that the signature on the personal file was a photocopy - not qualified for comparison. At the same time, the signature on the house purchase document and the notice of change of permanent residence did not have stable individual characteristics, making it impossible to determine whether the signature on the documents related to the child adoption was by the same person.
Hong Phuong fought to the end, Hong Loan's side released more evidence, 2 lawyers left. Đình Như07:18:11 15/11/2024On November 14, the Ho Chi Minh City People's Court held a meeting to examine the submission, access, disclosure of evidence and mediation in the inheritance dispute of Mr. Vo Van Ngoan (late Meritorious Artist Vu Linh).
