Is Dam Truc responsible for indirectly causing the Fat Cat to leave?

The heartbreaking incident about the love affair between Dam Truc and Fat Cat, which lasted more than 2 years and is preparing to enter into marriage, has caused a stir among netizens in recent days. It seemed to have a beautiful ending but turned into an outrageous controversy.

It is known that the Fat Cat is a guy who is only 21 years old. Before thinking negatively, Dam Truc – Fat Cat's girlfriend, 6 years older than him, announced their separation from him even though the two had planned to prepare for the wedding in May this year.

The incident was discovered by Fat Cat's sister, the angry chat between Dam Truc and him has become a hot topic on social media. Social media accounts have released a series of evidence that Dam Truc flirted and transferred money to many others during her dating Fat Cat.

An account posted a chat and photos proving Dam Truc had transferred funds to some people from 2023. It is noteworthy that Dam Truc's transfer amount is usually 1,314 yuan, a number with special meaning in slang, equivalent to "the most born in the world" - one life and one lifetime.

Another girl revealed that she herself was a "reluctant little trio" and dated Dam Truc while she and Fat Cat were still in love. She claimed that she had no knowledge of the relationship between Dam Truc and her boyfriend, who was born in 2003.

According to Vietnamese law, the act of self-ending life is still not clearly stipulated, but Article 19 of the 2013 Constitution says that everyone has the right to life, human life is protected by law. No one should be unlawfully deprived of life.

Thus, the above act is against the right to life stipulated in the 2013 Constitution.

Fat Cat is gone, is Dam Truc responsible?

According to the Criminal Code 2015 (amended and supplemented in 2017), there are currently 02 crimes related to the above act, including the crime of inciting or helping others to do it.

Pursuant to Article 130 of the 2015 Penal Code (amended and supplemented in 2017) stipulates as follows:

- Whoever treats evilly, regularly bullies, or humiliates his dependents to make him or her do such foolish things, shall be sentenced to imprisonment from 02 years to 07 years.

- Committing an offense in one of the following cases, shall be punished with imprisonment from 05 years to 12 years:

For 02 people or more;

For people under the age of 16, women who are known to be pregnant.

In addition, Article 131 of the 2015 Penal Code (amended and supplemented in 2017), stipulates the crime of inciting or helping others to commit the above acts as follows:

- Any person who commits one of the following acts shall be punished with re-education without detention for up to 03 years or imprisonment from 06 months to 03 years:

Inciting, enticing or motivating others to commit the above acts;

Create physical or mental conditions for others to perform the above behavior.

- The crime of causing 02 or more people shall be punished with imprisonment from 02 years to 07 years.

Basically, the law does not prohibit men and women from parting ways. When a boyfriend breaks up, grieves and acts like this, the law needs to consider whether the girlfriend exhibits signs such as bullying, abuse, or behaviors that cause the boyfriend to do so. If so, the girlfriend could be held criminally responsible.

Pursuant to Article 132 of the 2015 Penal Code (amended and supplemented in 2017) stipulates the crime of failing to help a person in a life-threatening condition as follows:

- Any person who finds another person in a dangerous condition, even if there are conditions without help resulting in his death, shall be punished with a warning, a penalty of non-custodial rehabilitation for up to 02 years or imprisonment from 03 months to 02 years.

- Committing an offense in one of the following cases, shall be punished with imprisonment from 01 year to 05 years:

A non-rescuer is someone who has unintentionally caused a dangerous situation;

A non-rescuer is a person who by law or profession is obliged to help.

- Crimes resulting in the death of 02 or more people shall be punished with imprisonment from 03 years to 07 years.

- Offenders may also be prohibited from holding office, practicing or doing certain jobs from 01 year to 05 years.

Thus, a person who has conditions that fail to help the person whose acts lead to danger of life can be examined for criminal liability up to 07 years in prison.
