The property dispute between tycoon Duc An and his ex-wife - supermodel Ngoc Thuy is gradually coming to an end. Accordingly, the court recently made a request for the male businessman's assets of about 288 billion VND.
According to recorded information, on the afternoon of October 26, the People's Court of Ho Chi Minh City continued the trial of the dispute over property ownership and division of common property after divorce between plaintiff Nguyen Duc An (61 years old, Vietnamese). American) and defendant Pham Thi Ngoc Thuy (43 years old, supermodel Ngoc Thuy).
At the beginning of the trial, the representative of the Ho Chi Minh City People's Procuracy expressed his opinion on the case.
According to the representative of the Ho Chi Minh City People's Procuracy, during the proceedings, the plaintiff withdrew part of the lawsuit request. Considering that the withdrawal of Mr. An's request is in accordance with the law, the Trial Council is requested to suspend the resolution.
Besides, in court, the plaintiff added a number of requests. The prosecution said that supermodel Ngoc Thuy's ex-husband's request exceeded the original content, so it did not consider it.
According to Mr. An's confession, the male businessman repeatedly sent Ms. Thuy a total of 13 million USD, which was all the personal money he had before the marriage, asking Ms. Thuy to buy and put in her name the assets in Vietnam. . Regarding the origin of the above money, Mr. An said this is his personal property formed before marriage.
However, Mr. An could not provide evidence, only providing authorization letters showing 3 million USD and 700,000 USD.
According to the Procuracy, it is necessary to determine that the amount of money Mr. An sent back and the assets that Ms. Thuy named during the marriage are common property of the couple. According to regulations, common property during marriage is divided equally between husband and wife after divorce. That's why the Procuracy asked the Trial Council to divide the disputed property between the two parties.
Specifically, the disputed assets between Mr. An and Ms. Thuy are proposed to be divided as follows:
4 apartments in District 1 are valued at 37 billion VND and continue to be assigned to Ms. Thuy to continue managing. Ms. Thuy is obligated to pay Mr. An back 50% of the value, equivalent to more than 18 billion VND.
5 apartments worth 45 billion VND were assigned to Mr. An to name and manage. Mr. An is obligated to pay Ngoc Thuy 50% of the value, equivalent to 22.5 billion VND.
A villa in Binh Thanh district was assigned to Ms. Thuy in her name. Ms. Thuy paid Mr. An 50% of the value, equivalent to 5.2 billion VND.
31% of Ngoc Thuy's shares are contributed capital to a company, and continue to be assigned to her name so as not to affect the company's operations. Ms. Thuy is obligated to pay Mr. An 50% of the value, equivalent to 2.3 billion VND.
The entire capital contribution at an interior real estate company is the right to use more than 3,700 m2 of the company's land. It is proposed to be assigned to Mr. An for ownership. Mr. An is obliged to pay Ngoc Thuy 50% of the value.
In addition, Mr. An said he sent Ms. Thuy 2 million USD to buy land in District 2 (now Thu Duc district). The evidence the plaintiff gave was the confirmation of Ms. Be (Thuy's mother), but she later declared that she "did not know anything about the sale" so there was no basis to accept Mr. An's testimony.
With 8 villas in one project, there are 4 that Ms. Thuy sold during her marriage, so there is currently no basis to determine that the defendant used the money from selling these villas. Thuy sold the remaining 4 houses after the divorce, using the money to pay for the purchase and sale of other assets, which is a basis for acceptance. However, these apartments are no longer available, so there is no basis to accept the plaintiff's request for property division.
As for the remaining 5 villas (in Ms. Be's name), Ngoc Thuy said her mother authorized Mr. An to sell them, but he denied. These apartments are no longer available, so there is no basis to divide according to the parties' requests.
Regarding the profits earned from renting 9 apartments in District 1, Viet Procurator accepted part of the plaintiff's request, forcing Ngoc Thuy to pay Mr. An 8.7 billion VND.
The Procuracy also asked the court to deny the plaintiff's request for an apartment in District 7, because the defendant bought this apartment after the divorce. Regarding Mr. An's request for more than 400 million VND and 700,000 USD in Ngoc Thuy's accounts, the Procuracy also said that there was no basis to accept.
According to the case file, Mr. An and Thuy got married in the US in 2006 and have 2 children together. In March 2008, the couple divorced in California state court, USA.
Two years later, Mr. An sent a lawsuit to the People's Court of Ho Chi Minh City, asking his ex-wife to return 39 types of assets purchased in Vietnam.
The plaintiff also said that after the divorce in the US, the California State Superior Court recorded the litigant's agreement and decided that in addition to the separate assets recognized by both parties, Ngoc Thuy must transfer the assets she currently owns. in Vietnam to join a joint company to hand over to the children when they turn 18 years old.
Because Ngoc Thuy did not comply with the above ruling, he continued to ask the court to force his ex-wife to hand over all assets to the children.
