Duc An added that after their divorce in the US in March 2008, the California Superior Court decided that "the assets owned by Ngoc Thuy must be recovered" to be paid to An, "because they were purchased with his own money".

However, Ms. Thuy later refused to pay the related assets, so Mr. Nguyen Duc An filed a petition to the court. In 2017, former supermodel Ngoc Thuy filed a counterclaim against her ex-husband's lawsuit request, sent to Ho Chi Minh City.

This is the first time the court has scheduled a hearing of the case after 13 years of collecting documents related to the disputed property.
