In 2015, Ms. Na married a boy of the same age in the same village as the suspect Tran Van Vien. However, after a period of living together, the couple often quarreled. Due to his brute force and brute nature, Vien often beat his wife when he drank alcohol and often got jealous for no reason.

In order to make a living and have money to support her children, Ms. Na had to pack her bags and move to Ho Chi Minh City to work as a worker at a garment company. Vien also followed Ho Chi Minh City for a while but was unemployed because of Covid-19 so he returned to his hometown to go fishing.

Seeing that I often drink alcohol, sometimes I hear that I use "American grass", Mrs. Le Thi Van (Vien's biological mother) tried her best to advise but could not.

"When he drank alcohol and used stimulants, his temper was brazen and aggressive, but he also loved his son very much. The day he went back by train, he also bought a gift for his son. I don't know why he caused an incident yesterday. It's so moving," said Mrs. Van chokingly.

It is known that due to suspicion that his wife, Na (working in Ho Chi Minh City) had an affair, around 19:30 on February 16, Vien went to Ms. Luu's house in the same Dong Tuan village, Tam Hai commune. At this time, baby Vy is also here.

During the conversation, Vien had an intention to kill his son, so he carried Vy to Tam Hai ferry and threw him into the river. After committing the crime, Vien went home to say goodbye to his mother and then went to the Commune Police to report. At dawn the next morning, after many hours of searching efforts, Vy's body was found about 50 meters from the scene of the incident. Vien also confessed that he killed his son to take revenge on his wife because Vien called Ms. N. but the woman did not listen.

Regarding this case that shocked public opinion, talking to PV, Nguyen Cong Tin - FDVN Law Firm - Da Nang City Bar Association said that Vien's barbaric and dehumanizing behavior must be subject to the law. strictly handled.

According to the provisions of the law, Vien's act has all the elements to constitute the crime of Murder as prescribed in Clause 1, Article 123 of the Penal Code 2015 (amended and supplemented in 2017), with an increased frame rate. "Murder under 16 years of age" is punishable by imprisonment from 12 to 20 years, life imprisonment or capital punishment.

Lawyer Nguyen Cong Tin said that, even if he used alcohol, beer or other stimulants, Vien still had to take full responsibility for his cruel behavior, because Article 13 of the 2015 Penal Code (amended, supplemented in 2017) clearly stipulates: "The offender in a state of loss of awareness or ability to control his or her behavior due to the use of alcohol, beer or other strong stimulants, shall still have to bear criminal responsibility. ".

"Vien's criminal motives are too petty, despicable, just from conflicts and jealousy with his wife, Vien is ready to kill his own child who is only a toddler and learns to speak. Vien's behavior is impossible. acceptable, showing disregard for the law and will certainly be punished by the law, but the pain of losing a child or grandchild will persist for the person who stayed behind, and with the victim's family.

Sharing the same opinion, lawyer Duong Van Phuc - FDVN Law Partnership - Thua Thien Hue Bar Association said that he himself felt shocked when watching the case. This is an inhuman and condemnable behavior of the father in the case because the victim is his 5-year-old biological daughter.

According to lawyer Phuc, the case stemmed from the father's blind jealousy. Worth mentioning, Vien had a ready plan to kill his daughter just for the sake of animal satisfaction to take revenge on his wife because of jealousy.
