Today, on August 10, Hanoi City TAND opened a preliminary hearing and tried Mr. Le Thanh Seren (73 years old, Chairman of the Board of Directors, General Director of Bemes Company Chairman of Muong Thanh Group) on the charge of "Deceiving customers".
According to information from Dan Tri newspaper, today (10/8), Mr. Le Thanh Seren (commonly known as the giant "dieu cay") was put on trial by the People's Court of Hanoi for deceiving customers, related to the CT6 Kien Hung project (Kien Hung ward, Ha Dong district, Hanoi).
Along with Mr. Tran, there are 6 people charged with Irresponsibility causing serious consequences, including: Nguyen Duy Uyen, former Chairman of Kien Hung Ward People's Committee (Ha Dong); Vuong Dang Quan, former Deputy Chief Inspector of Construction of Ha Dong District and officials Mai Quang Bai, Bui Van Bang, Do Van Hung, Nguyen Van Nam.
Mr. Le Thanh Seren used to be known by many nicknames, such as the giant "dieu cay", because he likes to smoke pipes. He is also known as the "affordable housing giant", because building a chain of condominiums with cheap prices no one can keep up in Hanoi.
Mr. Tran was criminally prosecuted as Chairman of the Board of Directors General Director of Bemes Company, the project investor.
At 9:00 a.m., Mr. Chen entered the trial hall. The 73-year-old moved slowly up to the defendant's area and sat in the first row.
Since early morning, hundreds of victims in the case have arrived in court. The secretary said 143 victims were present out of 504 summoned.
Talking to Vietnamese people, many of them affirmed that they want to continue living in the house bought from Mr. Le Thanh Tran, and hope the government will create conditions for making the red book. If they had to return the house and then get back the money they gave to Mr. Tran, they would definitely not agree.
According to the indictment, defendant Le Thanh Seren is the Chairman of the Board of Directors and General Director of Bemes Company. This company was allowed by the Hanoi People's Committee to change the purpose of land use, but Mr. Tran directed the construction in serious violation of the construction planning. Defendant Tran arbitrarily changed the purpose of land use, seriously violated the planning approved by the competent authority.
With the high-rise block, the defendant Le Thanh Seren directed to increase the construction area, increase the height of the building, and change the usability. Bemes also built an increase in apartments and added a CT6C building that was not included in the approved plan. For low-rise buildings, Bemes Company increased the area of land built and the number of low-rise units, violating the red line limit.
According to information from VietNamNet, since 3/2011, Mr. Le Thanh Seren has falsely advertised the legality of the project that: "The project has been approved, the apartment design and the design of the work comply with regulations on construction, the selling price of the apartment includes the value of land use rights..." for customers to trust to buy houses, even if the construction works seriously violate the approved planning.
The indictment determined that Mr. Le Thanh Seren sold 488 apartments (to 488 customers) without being recognized by the State for land use rights, house ownership and other assets attached to land (red book), making illicit profits totaling more than VND 481 billion.
This is also the amount that caused serious losses to 488 customers (including the value of land use rights of more than VND 56 billion).
The allegation is that the defendants, former Vice Chairman of Kien Hung Ward People's Committee at various periods and former construction inspectors of Ha Dong district, failed to inspect, inspect and detect violations to prevent and handle violations at the construction work of Kien Hung CT6 Project in accordance with the law, causing losses of more than VND 481 billion.
Before the trial, Mr. Nguyen Trong Tue (SN 1975, in CT6C Kien Hung apartment, Ha Dong) and some residents of the same apartment complex made appeals for help.
Mr. Tue and the residents wish to be granted certificates of land use rights, ownership of houses and other assets attached to the land for the apartments of CT6C building.
In case the apartments of CT6C building are not granted certificates of land use rights, house ownership and other assets attached to the land, Mr. Le Thanh Seren and the investor must jointly be responsible for compensating the damages satisfactorily to the victims to overcome the consequences caused by the defendant.
