Accordingly, on September 8, the People's Court of Ho Chi Minh City HCMC appealed the case of disrupting public order against Nguyen Xuan Huong Trang (31 years old, also known as Trang Nemo), Pham Quyen Quy, Nguyen Ngoc Khuong and Phan Hoang Nam (also employees of Trang Nemo shop).

The case was brought to an appellate hearing due to an appeal by the defendants and Ms. Pham Le Khanh, who has an interest in related obligations.

Trang Nemo, Pham Quyen Quy, Nguyen Ngoc Khuong and their accomplices appeared in court early in the morning. Defendant Phan Hoang Nam – the defendant with the heaviest sentence in the case – was absent for no reason.

At the same time, 3 defense lawyers for the defendants were absent without cause. Speaking to the jury, Page Nemo said the lawyers were busy so they did not come, thus not agreeing to a trial without a defense attorney.

The jury found it unusual for the lawyers to be in the same office but simultaneously absent, deliberately delaying the trial. The presiding judge also explained that the defendants were guaranteed their rights and interests, the defendants had lawyers to protect them, lawyers had access and studied the records but were absent for no reason, so the defendants had to defend themselves.

On behalf of the defendants, Page Nemo applied for an adjournment of the trial to invite a lawyer but was not accepted by the jury. The trial continues to work. Therefore, VKS recommends that the appellate council reject the appeal of defendant Trang and related persons and pronounce a judgment of first instance.

Previously, the People's Court of District 1 at first instance sentenced Trang Nemo, Pham Quyen Quy, Nguyen Ngoc Khuong to 9 months in prison. Defendant Phan Hoang Nam received 12 months in prison together for disrupting public order.

Recently, the plaintiff in the case, Ms. Le Khanh, has just had more information about the development of the appeal court on September 8. Accordingly, Ms. Khanh revealed that Page Nemo has hired up to 4 lawyers to defend her. But then let all 4 lawyers stay at home to ask for an adjournment of the trial. Who asked the court not to adjourn but asked Trang to defend himself otherwise the old sentence.

"Nemo's page was wronged by legal counsel so it was pushed to this day. At first he didn't want to be on trial, very confident. Don't let 4 lawyers come. Thought it would be suspended. And an appellant on that side did not come. But I doubt being scolded for 1 increase. You know what the intentions are. Wanting to delay the trial, that's it. There's no one, there's no lawyer. So we have to defend ourselves. That's it. A bad move. The person who counts is not equal to heaven.

As for Page Nemo, she claimed that when the incident happened at her store, she sent fruit baskets to her house to apologize to the victim but was denied being sincere enough. The former hotgirl explained why she did not issue a direct apology out of concern for her own safety, so she took a knee to apologize in court.

According to Article 67 of the 2015 Penal Code amended and supplemented in 2017 stipulates the postponement of imprisonment sentences. In particular, pregnant women or nursing children under 36 months old (ie under 3 years old) are postponed until the child reaches 36 months old.

During the period of deferral of imprisonment, if a person to be postponed commits a new offense, the Court shall compel that person to serve the previous penalty and summarize the penalty of the new sentence as prescribed in Article 56 of this Code.

Compared to the case of Page Nemo, she is currently raising 1 small child, the baby was born at the end of October 2020. Therefore, by the end of October 2023, Page Nemo's son will be 3 years old. That's about two months away from the baby turning 36 months old, according to rules Nemo can postpone the execution of his prison sentence until the end of October 2023, when his son turns 36 months old.

If this is followed and no further appeals are made, with a period of 9 months in jail, Page Nemo will serve his sentence from the end of October 2023 to around the end of July 2024.
