According to the provisions of Clause 11, Article 6 of the Law on Children 2016, prohibited acts; including acts: Publishing and disclosing information about the private life and personal secrets of children without the consent of children aged full 7 years or older; and of parents, guardians of children.

"Thus, if the child is under 7 years old, it will not be illegal for parents to post information in the secret group of their children's private life on social networks. As for posting images of children aged 7 years and older on social networks, they must have the consent of the child and their parents, or guardians.

Because this is an act of disclosing information about private life; children's personal secrets. If posted without consent, this act is a violation of the law. It means that the behavior of the other male rapper is against the law," said lawyer Hung.

According to lawyer Hung, pursuant to Article 31 of Decree 130/2021/ND-CP: Violating regulations on prohibiting the publication and disclosure of information about children's private lives and personal secrets will:

"A fine of between VND 20,000,000 and VND 30,000,000 shall be imposed for the act of disclosing or disclosing one of the following information without the consent of parents, caregivers, guardians of children and children aged full 07 years or older, including: name, age; personal identification characteristics; information about health status and private life recorded in medical records; personal image; information about family members and caregivers of children; personal property; phone number; personal mailing address; address and information about the place of residence and hometown; addresses and information about children's schools, classes, academic results and friendships; information about services provided to individual children.

The lawyer added: "If the image is used and violated, the person with the image has the right to request the Court to issue a decision to force the violator, relevant agencies, organizations and individuals to withdraw, destroy and terminate the use of the image, compensate for damage; and apply other handling measures as prescribed by law. Thus, parents, guardians and agencies, organizations and individuals are responsible for protecting children in accordance with law; have the right to initiate a lawsuit to request the termination of the use of the image, compensation for damages".

At the same time, for the act of indiscriminately commenting and speaking on social networks, the Law on Cyber Security 2018 has clearly stipulated the acts of posting illegal information on the internet such as insulting the honor, dignity and reputation of others, information that is not in accordance with ethical standards, etc Fine customs and customs are prohibited acts.

Decree No. 15/2020/ND-CP (amended in Decree 14/2022/ND-CP) on administrative sanctions in the field of post and telecommunications on radio frequencies also stipulates sanctions for acts of providing and sharing information and cultural products contrary to social ethics and fine customs of Vietnam. This act can be fined from 5 to 10 million VND or in the penalty bracket from 20,000,000 VND to 30,000,000 VND depending on the severity of the act.

"In case the male rapper posts a photo of the child on social networks without the consent of the family, and there are comments that are not in line with moral standards and fine customs, the young family has the right to sue and claim compensation for damages," the lawyer said.
