According to the initial investigation, on September 9, driver L. was driving a 4-wheel vehicle with license plate number 92A-130.76 on Highway L1A, passing through Giang Nam 1 village (Hoa Phuoc commune, Hoa Vang district), when he collided with Ms. Le Thi H. (born 1963, residing in Hoa Phuoc commune) is riding a bicycle on the road.

The collision caused Ms. H. to fall on the road, seriously injured, and was taken to the emergency room but did not survive immediately.

During the investigation, authorities determined that male driver L. tested positive for a banned substance.

Working with the police, L. initially confessed that that day, after using banned substances, L. drove the above car and caused an accident.

Currently, the Police Investigation Agency of Hoa Vang District Police continues to investigate and clarify the case, completing the dossier to handle L. according to regulations.

Pursuant to Clause 10, Clause 11, Article 5 of Decree 100/2019/ND-CP amended by Point c, Clause 34, Article 2 of Decree 123/2021/ND-CP stipulates as follows:

A fine of from 30,000,000 VND to 40,000,000 VND shall be imposed on the driver who commits one of the violations against drivers on the road with a banned substance in their body.

In addition to being fined, vehicle drivers who commit violations are also subject to the following additional penalties:

- Committing the acts specified in Point e, Clause 4 of this Article will result in confiscation of priority signaling equipment installed and used in contravention of regulations;

- Suspension of the right to use a driver's license for the lightest period from 01 month to 03 months and the most serious period for the period from 22 months to 24 months depending on the severity of the case;

Pursuant to Article 260 of the 2015 Penal Code as amended by Clause 72, Article 1 of the Law amending the 2017 Penal Code as follows:

Any person participating in road traffic who violates road traffic safety regulations and causes damage to others in one of the following cases will be fined from 30,000,000 VND to 100,000,000 VND, Non-custodial reform for up to 03 years or sentence from 01 year to 05 years:

- Causing human damage;

- Causing injury or harm to the health of 01 person with a bodily injury rate of 61% or higher;

- Causing injury or harm to the health of 02 or more people with a total bodily injury rate of 61% to 121%;

- Causing property damage from 100,000,000 VND to under 500,000,000 VND.

Committing a crime in one of the following cases shall be sentenced to between 03 and 10 years:

- Does not have a driving license according to regulations;

- In the state of using alcohol or beer with an alcohol concentration in the blood or breath exceeding the prescribed level, or using banned substances or other strong stimulants;

- Running away to avoid responsibility or intentionally not helping the victim;

- Failure to obey the driver's orders or traffic instructions;

- Causing damage to 02 people;

Committing a crime in one of the following cases shall be sentenced to between 07 and 15 years:

- Causing damage to 3 or more people;

- Causing injury or harm to the health of 03 or more people with a total bodily injury rate of 201% or more;

- Causing property damage of VND 1,500,000,000 or more.

Violating regulations on participating in road traffic and the consequences are not promptly prevented will result in a fine of from 10,000,000 VND to 50,000,000 VND, non-custodial reform for up to 01 year or a sentence of 03 years. month to 01 year.

Offenders may also be banned from holding certain positions, practicing certain occupations or doing certain jobs for from 01 year to 05 years.
