The People's Court of Thu Duc City (Ho Chi Minh City) has just received an appeal from Ms. Tra Ngoc Hang (model, 34 years old, living in Thu Duc City). This person is the defendant in the case of reclaiming property with Mr. Nguyen Quang Tan (39 years old, from Gia Lai). Previously, in the first-instance trial, the court declared to accept all of Mr. Tan's petition, forcing Ms. Hang to return 2.5 billion VND. Disagreeing with the above ruling, the defendant appealed.

In the appeal, Ms. Hang proposed that the appellate level amend the first-instance judgment in the direction of not forcing her to pay Mr. Nguyen Quang Tan 2.5 billion VND.

According to the records, Nguyen Quang Tan knew Tra Ngoc Hang through the introduction of his girlfriend, Miss Oanh Yen.

Because Tra Ngoc Hang needs financial support, Mr. Tan trusts and assigns the land under his ownership in Lam Dong as collateral for the loan of VND 13.2 billion at Vietnam Prosperity Joint Stock Commercial Bank.

After disbursement, Tra Ngoc Hang kept 2.5 billion VND, Mr. Tan kept 10.7 billion VND. Each person pays the interest arising from the principal loan amount by themselves.

Some time later, Tra Ngoc Hang stopped paying interest, not following the original agreement. After that, Mr. Tan settled the entire loan and asked Ms. Hang to return the amount of 2.5 billion VND, but this woman did not agree. Therefore, he filed a lawsuit with the People's Court of Thu Duc City to ask Ms. Hang to reimburse the above amount.

Meanwhile, the female model said that there was an agreement and commitment between her and Mr. Tan. However, the plaintiff did not perform properly, causing the defendant to fall into bad debts, the bank recovered the assets, so it was not obliged to return the amount of VND 2.5 billion to Mr. Tan.

In addition, Ms. Hang handed over the evidence to prove the statement that between Mr. Tan and Ms. Hang, there was an agreement, Mr. Tan promised to handle bad debts for the defendant. Specifically, according to the agreement, in case Mr. Tan fails to pay interest to the bank, causing Ms. Hang to have bad debts at the bank, Ms. Hang does not pay debts and does not pay interest on the amount of VND 2.5 billion.

The Board of Directors considered the entire content of the above micro-certificate and did not find the agreement as presented by Ms. Hang.

The Board of Directors said that regarding the loan, the two confirmed that Mr. Tan carried out procedures for Ms. Hang to legalize the loan of VND 13.2 billion with the bank. Pursuant to Articles 91 and 92 of the CCP, Article 166 of the Civil Code, the Board of Directors determined that Mr. Tan was the person who actually paid the loan of VND 13.2 billion to the bank, Ms. Hang received VND 2.5 billion out of the loan of VND 13.2 billion and Mr. Tan had the right to reclaim the amount of VND 2.5 billion.

Since then, the court declared to accept all the claims in the plaintiff's lawsuit, forcing Ms. Tra Ngoc Hang to return to Mr. Nguyen Quang Tan the amount of VND 2.5 billion.
