According to lawyer Phan Hoa Nhut, Director of The Law Law Firm, the purchase and sale of miss prizes, the Criminal Law does not have any separate criminal provisions for this act.

Regarding administrative sanctions, Article 12 of Decree 38/2021 provides for the beauty and model contest with a fine of VND 5-50 million and additional penalties. In fact, there is no description of the sale of the prize. However, if this provision is well applied, it can also sanction administrative violations for the act of buying and selling miss prizes.

According to lawyer Phan Hoa Nhut, only criminal violations under Article 174 of the current Penal Code on the crime of deceiving and appropriating property with the act of buying and selling miss prizes when the contestants in the contest prove that the contest has organized the purchase and sale of prizes.

"The reason why other contestants when registering also pay exam fees and other time and expenses for the competition. And when the award was set for the buyer, the other contestants became victims of an organized trick. However, the condition is that the victims will come forward to denounce and prove the purchase and sale of the miss prize," said lawyer Phan Hoa Nhut.
