On June 24, the High-Level People's Court in Ho Chi Minh City opened an appeal hearing to hear a property inheritance dispute related to the legacy of the late Meritorious Artist Vu Linh, one of the cai luong icons beloved by the public for decades.
However, the trial could not proceed as scheduled when many people with related rights and obligations were absent, leading to the decision to postpone the trial.
The appeal case was opened based on the appeal of the parties involved in the property inheritance dispute, and also included requests to cancel individual decisions and reclaim houses that were once given to them to stay in, all of which are related to the legacy of the late Meritorious Artist Vu Linh.
The plaintiff in the case is Ms. Vo Thi Hong Nhung, the late artist’s younger sister. The defendant is Ms. Vo Thi Hong Loan, his only daughter. The dispute not only revolves around inheritance rights, but also raises many legal questions about the validity of documents, signatures and administrative decisions related to the estate.
During the procedural examination of the trial, the secretary informed that Mr. Vo Thanh Nhieu, the person identified as having related rights and obligations, and his legal representative were absent without reason. In addition, representatives of the Notary Office and the People's Committee of Phu Nhuan District were also absent from the trial, although these two units had submitted written requests for absence in advance.
In that situation, the representative of the High People's Procuracy in Ho Chi Minh City stated: This is the first time the appeal trial has been opened, and with some people with related rights and obligations absent without reason, postponing the trial is necessary to ensure the legitimate rights of the parties.
The lawyer defending Ms. Vo Thi Hong Loan also agreed with the request to postpone the trial. According to him, Mr. Vo Thanh Nhieu's first absence was sufficient to temporarily postpone the trial in accordance with legal regulations. The People's Committee of Phu Nhuan District and the Notary Office had sent a written request for absence, so there was no procedural violation.
Meanwhile, Ms. Vo Thi Hong Nhung, the plaintiff, provided new and noteworthy information. According to her, Mr. Vo Thanh Nhieu has not yet received a summons from the court, so his absence is inevitable. More importantly, Ms. Nhung said that she has filed an official petition requesting the court to re-examine the signature of the late Meritorious Artist Vu Linh on a number of documents related to the dispute, including a document showing consent for others to use or inherit the property. Ms. Nhung's lawyer emphasized: The petition for signature appraisal has been sent with specific documents and evidence, but has not yet been considered and resolved by the appellate court.
In response to the opinions and recommendations from the parties, the Trial Panel held an on-site consultation. After comprehensively considering factors including the interests of the parties, the legality of the proceedings and the request for additional evidence, the Trial Panel decided to adjourn the trial to ensure that the trial process is objective and complete. The time to reopen the trial will be announced later.
Notably, the panel of judges also confirmed that they would consider the request to re-appraise the late Meritorious Artist Vu Linh’s signature during the adjournment of the trial. This could be an important detail that would greatly affect the final outcome of the case, because if the signature is determined to be forged or unclear, the validity of the documents related to the inheritance could be invalidated.
The lawsuit is not only a legal story about property but also attracts special attention from the public, especially artists and fans of the late Meritorious Artist Vu Linh, who devoted his life to the Vietnamese reformed theater. The fact that the famous artist's family is involved in a legal dispute after his death has created many mixed opinions.
