Vu Linh's daughter and her lawyer went to court to appeal, the content of the petition attracted attention.

Vo Thi Hong Loan (daughter of the late artist Vu Linh) appealed part of the verdict of the Ho Chi Minh City People's Court regarding the administrative lawsuit and property claim between her and the plaintiff, Ms. Vo Thi Hong Nhung (61 years old, younger sister of the late artist Vu Linh).

At 10am on January 17, Ms. Vo Thi Hong Loan (daughter of the late artist Vu Linh) and her lawyer went to court to file an appeal against the first instance verdict. Hong Loan appeared with a cheerful face, without anxiety and full of confidence to interact with the media.

According to the appeal, the court's decision that Ms. Nhung was entitled to 15% of the total value of the inheritance left by her father - Mr. Vo Van Ngoan (the late artist Vu Linh) was baseless, because the court determined that she was the legitimate child, the only person in the first line of inheritance of the late artist.

According to Ms. Loan, Ms. Vo Thi Hong Nhung did not contribute to Mr. Ngoan's legacy at all. In particular, in 1991, 1995, and 1998, when Mr. Ngoan created the assets, Ms. Nhung did not live with her and her father, did not contribute, did not manage, did not preserve, did not embellish the value of Mr. Ngoan's legacy, and also caused Mr. Ngoan to lose a lot of assets because he had to pay debts on behalf of Ms. Nhung.

"Mrs. Nhung's care of my grandmother (if any) is the duty of children to their parents, not the sole duty of my father. In fact, my father worked hard to support the whole family, including Mrs. Nhung," Hong Loan wrote in her appeal. From there, she believes that the court of first instance's consideration of Mrs. Nhung's efforts based on the above grounds and arguments is incorrect and "exceeds the scope of Mrs. Nhung's lawsuit request."

Specifically, according to Ms. Loan, Ms. Nhung sold the house on Vo Di Nguy Street, Go Vap District (called the family's ancestral house) because of business losses. Since 1991, Mr. Ngoan has moved to live at No. 5 Doan Thi Diem, Phu Nhuan District until his death. Meanwhile, the above assets were created by Mr. Ngoan in 1991, 1995, 1998, meaning after Mr. Ngoan separated his household registration to live separately.

Previously, on January 7, the Ho Chi Minh City People's Court said that there was a basis to determine that since 1973, when the late artist Vu Linh lived with his mother, Mrs. Nhung and younger brother in a house in Go Vap district, he had been touring everywhere. Mrs. Nhung was the one who took care of his elderly mother so that he had time to focus on his career; managed the family and supported him in taking care of and raising Loan... which contributed significantly to the late artist's ability to focus on his work and develop his career with peace of mind.

The panel of judges applied the precedent 05/2016/AL considering that Ms. Nhung's request to receive the entire inheritance was greater than the consideration of the merits, so it should be resolved in the same case. In addition, based on Clause 2, Article 6 of the Civil Code, in cases where it is not possible to apply the law similarly, the basic principles of civil law stipulated in Article 3 of this Code should be applied as precedents and as fair. From there, the panel of judges decided that calculating Ms. Nhung's merits at 15% of the total value of the late artist Vu Linh's inheritance is "not against the law and is fair".

Hong Loan believes that the Ho Chi Minh City People's Court did not apply the spirit of Precedent 05/2026/AL and "fairness" when it sentenced Ms. Hong Nhung to 15% of the late artist Vu Linh's inheritance. If the court had resolved the case on a humane and emotional basis, it should have asked for opinions and analyzed so that Hong Loan would agree and acknowledge her willingness to help Ms. Hong Nhung, then the verdict would have been reasonable and sympathetic.

Hong Loan filed a petition asking the High People's Court in Ho Chi Minh City to review the appeal and amend the first instance judgment to not allow Ms. Hong Nhung to enjoy 15% of artist Vu Linh's inheritance.
