Fired for entering the wrong women's restroom for 10 seconds, the male employee sued the company

Entering the wrong women's restroom, a male employee who worked at the company for 9 years was immediately fired. He sued the company and demanded compensation for voluntarily canceling the labor contract.

At the court of Zhongshan city, Guangdong province, China, a seemingly simple but controversial lawsuit took place. The plaintiff in the lawsuit is a man named Truong, who was fired by the toy company where he worked after accidentally entering the wrong women's restroom.

Accordingly, a female employee of the company said that while she was using the restroom, a male employee named Truong suddenly walked in. He was in the women's restroom for about 10 seconds then got out and ran to the men's restroom.

After company leaders learned of the incident, Truong was fired on the same day for violating the rules. Dissatisfied with this decision, Mr. Truong sued the company in court, demanding compensation of up to 48,600 yuan (equivalent to 166.5 million VND).

Truong declared that that day, he had diarrhea and had severe stomach pain. He rushed to the bathroom and accidentally entered the women's toilet in an emergency, with absolutely no intention of peeping. Furthermore, the time he stood in the women's restroom was no more than 10 seconds, and he could not see any sensitive scenes. The company did not clearly define right from wrong, but determined that Truong had violated the rules with the error "Intentionally causing trouble in the company" and fired him immediately.

However, during the trial, the judge made a decision not to support Mr. Truong. The judge said that Mr. Truong had worked for the company for 9 years, it could be seen that he was a veteran employee, so he must have a very clear sense and position of the location and situation of the toilet, unable to do so. There is a problem of going to the wrong toilet due to poor physical condition.

In the end, Mr. Truong was determined by the judge to have intentionally done bad things, violated the female employee's privacy, and violated good customs. Thus, it is reasonable for the company to terminate the labor contract with Truong. As a result, Mr. Truong lost the lawsuit and the company did not need to compensate as he requested.

Men mistakenly entering women's restrooms is a matter of concern for many people, and many women worry about their own safety. Currently in a developed country like Korea, they have plans to use technology based on AI (artificial intelligence) to detect men entering and leaving women's restrooms.

Seoul Metro announced that it will pilot an AI-based gender detection system from the end of June 2023 and last about 6 months. The first location is the women's restroom at Sinseol-dong Station, according to KBS.

Seoul Metro said the expansion will only begin after the program's reliability is confirmed.

The detector can automatically detect a person's gender (based on body shape, clothing, furniture, behavior patterns), display CCTV images and broadcast notifications.

Considering that most of the staff who clean restrooms in subway stations are now women, the corporation will temporarily suspend the installation of this system in men's restrooms.

However, some people expressed skepticism.

"Do they guarantee that all women look exactly the same?", "Does installing machines in women's restrooms really stop men from coming?" are some of the opinions given.

According to KBS , the system was built as a preventive measure after a serious case occurred in a restroom at a subway station.

On September 14, 2022, a male Seoul Metro employee murdered his 28-year-old female colleague in the women's restroom at Sindang station because of his love rejection. The perpetrator was sentenced to 40 years in prison, according to BBC.
