Recently, social networks have been buzzing with information that bab.y Bap (born in 2021) continues to appear on GoFundMe, a US-based crowdfunding site, which has been shared by many people.
The campaign is called "Give Hope to Bab.y Bap's Recovery". The campaign was just launched on March 11, with the goal of raising $30,000 (more than 766 million VND) and has not received any support yet.
The campaign creator identified herself as Christina Nguyen and used the profile picture of Ms. Nguyen Phuong Hang, with an address in McKinney, Texas, USA. Many people recognized this as the TikTok account name Ms. Hang used after leaving Vietnam.
Notably, also on this platform, social media users discovered another campaign opened to raise funds for bab.y Bap called "Give Hope to MH: Fund His Treatment". The campaign was opened 4 days ago, with a goal of raising 300,000 USD (about more than 7.6 billion VND). The fundraiser claimed to be bab.y Bap's uncle, named Tam Bui Minh, with an address in Nevada, California.
GoFundMe is an online crowdfunding platform, founded in 2010 in the United States. It is one of the most popular fundraising websites in the world, allowing individuals and organizations to raise mone.y for purposes such as medical expenses, disaster relief, education, charity, startups and many other fields.
Anyone can create a campaign by registering an account, describing their story, and setting a fundraising goal. They can then share the campaign via social media, email, or other means to solicit donations. Donations are transferred directly to recipientsâ bank accounts.
Under this mechanism, GoFundMe verifies identity, but this information is not made public. Only GoFundMe or the recipient of the funds can confirm the true identity of the fundraiser. In addition to the identity verification mechanism, GoFundMe also has a refund policy in certain cases of fraud. However, because anyone can create a campaign, there is still the risk of fake campaigns.
Previously, Ms. Le Thi Thu Hoa (bab.y Bap's mother) said that she had received donations from two charity funds " Give.Asia" (based in Singapore) and "GoFundMe". However, after the "controversy" that occurred, both of these campaigns have now been stopped.
However, this has raised many questions among the public in Vietnam, especially when on GoFundMe there have been two fundraising campaigns related to bab.y Bap - a chil.d with cancer, while the case of the amount of 16.7 billion VND in the charity account under Pham Thoai's name "evaporating" has not been clarified yet.
At noon on March 12, many users in Vietnam discovered that they could not access the crowdfunding website GoFundMe using Vietnamese IP addresses. Meanwhile, if using VPN or foreign IP addresses, they can still access normally. The cause of the problem is currently unknown. However, this has raised many questions among the public in Vietnam.
According to lawyer Le Van Thanh (Ho Chi Minh City Bar Association), regarding the incident of accessing GoFundMe in Vietnam, users need to comply with current legal regulations when participating in online fundraising activities.
Regarding fundraising campaigns related to Bap, the lawyer advised people to carefully consider the fundraising organizer, transparent information about the amount of mone.y and the purpose of use before donating. Online fundraising platforms have mechanisms to protect users, but if fraudulent campaigns appear, donors may los.e mone.y without being able to get it back.
If an individual in Vietnam impersonates or commits fraud on these donation platforms, they can still be prosecuted under Vietnamese law. In the event that the victi.m wishes to sue or make a complaint, they may have to work with the authorities in their place of residence. However, this will be more complicated than with domestically operating platforms. Since these donation platforms are based overseas, the rights of users in Vietnam can be greatly affected in the event of a dispute.
In case of detecting acts of identity fraud or unauthorized use of other people's images to create fundraising campaigns, affected individuals have the right to request the platform to remove false information and file a complaint with the authorities. Therefore, lawyer Thanh recommends being careful when participating in donations or organizing fundraising to avoid unnecessary risks.
