The case of the woman driving a karaoke car: Deliberately lying, evading the law

Regarding the incident of a woman driving and singing karaoke live on Facebook, which caused public outrage, this person has been identified as Ms. NTL (32 years old, in Hoa An commune, Krong Pak district, Dak Lak province).

Krong Pak District Police informed that when working with the Traffic Police Team, Ms. L. gave a vague and dishonest statement. Accordingly, Ms. L. initially confessed that on December 10, she drove a 7-seat car, carrying 6 employees to serve a wedding party in Tuy Duc District (Dak Nong Province). That same afternoon, while driving home, she sang karaoke for entertainment.

However, the police determined that Ms. L. was driving a pickup truck, not a 7-seater car as she had claimed. After the fight, she finally admitted to driving the pickup truck with license plate 47C-163.27, carrying 6 women (2 in the passenger seat, 4 in the back seat). At the same time, the owner of the wedding restaurant admitted that holding the microphone while driving, carrying more people than the number of people in the car was against the regulations. Afterwards, Ms. L. drove the pickup truck to the police station to present herself and handle it according to regulations.

Previously, on the afternoon of December 10, Ms. L. drove a pickup truck carrying 6 people from Dak Nong to Dak Lak. While traveling on Ho Chi Minh Road through Tuy Duc District (Dak Nong Province), the people in the car turned on karaoke to sing and gave the microphone to Ms. L. to sing with. Even though she was driving, Ms. L. still held the microphone to sing, laugh and livestream on her personal page.

Ms. L.'s actions made many people angry because of the potential risk of unsafety when participating in traffic, disregarding the lives of themselves and others. When seeing the disagreeing comments, Ms. L.'s group turned off the livestream and locked Facebook, but netizens had time to save and spread it on social networks. Krong Pak District Police have now completed the working file with Ms. L. and sent a document to Dak Nong Provincial Police to coordinate in handling the violation according to regulations.

From a legal perspective, lawyer Nguyen Van Nam - Hanoi Bar Association said that the clip shows that Ms. NTL's behavior of not focusing on driving a car on the road and using a microphone to sing karaoke is dangerous, potentially causing traffic accidents, threatening the health and lives of others, this is a violation of regulations on ensuring traffic safety.

Specifically, Clause 23, Article 8 of the 2008 Law on Road Traffic Safety strictly prohibits violations of road traffic rules and other acts that endanger people and vehicles participating in road traffic.

According to lawyer Nam, if there is damage to property or the life or health of others, the driver may be prosecuted under Article 260 of the 2015 Penal Code, amended and supplemented in 2017.

Accordingly, the maximum penalty for this crime can be up to 15 years in prison. In addition, the offender can also be banned from holding a position, practicing a profession or doing certain jobs from 1 to 5 years.

According to the Traffic Police Department of Dak Nong Province, on December 10 and 11, the unit discovered, verified, and recorded 10 cases of bus drivers using their phones while driving.

In which, there were 3 cases where car drivers voluntarily went to the Provincial Police Traffic Police Department to report their violations and signed a commitment to strictly comply with the Road Traffic Law. For example, on December 11, Mr. TVĐ. (born in 1963, residing in Lam Dong), went to the Dak Nong Provincial Police Traffic Police Department to report his violation of using a mobile phone while driving a passenger car.

According to Mr. D.'s report that morning, he drove a passenger bus through Dak Nong province. While driving, Mr. D. used his mobile phone to handle work. After learning that the Dak Nong Traffic Police had handled the driver using his phone while driving and realizing that his actions were wrong, Mr. D. went to the Traffic Police Department to confess his violation.
