Although released, but 4 flight attendants have now been fired. Before that, social networks stirred up information that the chief flight attendant was a single mother raising a small child. In addition, if the case cannot be found, the case will have to be suspended.
On March 22, the Investigative Police Agency of the Ho Chi Minh City Police Department issued a decision to release 4 flight attendants carrying 11kg of banned substances because there were not enough grounds for criminal prosecution. However, the investigating agency has also instituted a criminal case to clarify the nature of the incident and strictly handle the subjects involved.
Citing news from VTC New, lawyer Dang Van Cuong - Head of the French Law Office said: "So far, the authorities have prosecuted the criminal case for investigation. The authorities will clarify who has committed the crime. carry out the act of illegally trading in banned substances to prosecute the accused.
During the investigation of the case, if the police cannot identify the person who gave the banned substance to the 4 flight attendants or the recipient, the case will be temporarily suspended in accordance with the law."
Lawyer Cuong analyzed, according to Article 230 of the 2015 Criminal Procedure Code, the investigating agency issued a decision to suspend the investigation when the time limit for investigating the case had expired without proving that the accused had committed the crime.
Article 172 of the 2015 Criminal Procedure Code stipulates that the time limit for investigating criminal cases shall not exceed 2 months for less serious crimes, not more than 3 months for serious crimes, and not more than 4 months for very serious crimes and particularly serious crimes from the time the case is prosecuted until the end of the investigation.
"The release of 4 flight attendants is due to the verification results that have made it clear that these people did not know this is a banned substance. However, this release is not a circumstance to close the case. The agency conducting the proceedings will continue to clarify who the above banned substances belong to, and who asked them to illegally transport them to Vietnam," said lawyer Dang Van Cuong.
Regarding the incident, 4 flight attendants who brought illegal drugs back from France have not been prosecuted, but have now been dismissed. On the contrary, some registration officers have been prosecuted but still have to work.
According to the leader of the Civil Aviation Authority of Vietnam, 4 flight attendants who bring banned substances back home via air will be handled according to Circular 46/2013 of the Ministry of Transport guiding the implementation of a specific labor discipline regime for employees. air.
However, what many people wonder is that in this case, 4 flight attendants were fired before they were prosecuted by the investigative agency. This is almost in contrast to other current developments, in the cases at many registration centers, a series of registration officers have been prosecuted and are still mobilized to work.
Responding to this issue, lawyer Nguyen Duc Chanh (Ho Chi Minh City Bar Association) said that those are two different cases, which are strictly applied according to the provisions of the law to each case.
According to the lawyer, aviation is a specific industry and has its own regulations on specific discipline. Accordingly, even though these flight attendants may not be criminally prosecuted (currently the case is still under investigation), they are still subject to industry-specific discipline "not used as a job as an aviation officer in any enterprise operating in the field of civil aviation".
Previously, related to the above incident, Ms. Tran Ha Thuy, also known as Thuy Bi, expressed her views on her personal page and revealed the situation of the head hostess. Accordingly, Ms. Thuy revealed that one of the four flight attendants above is a single mother, with small children, in very poor circumstances. "In this case, it is both pitiful and reprehensible," she wrote.
The above information has not been determined, but has surprised many people and caused conflicting controversy. Many people believe that Thuy Bi should not reveal the situation of the hostess, when the matter is not over. Besides, some comments said that, no matter how pitiful the circumstances, breaking the law is unacceptable. At the same time, netizens also believe that it is not possible to rely on circumstances as a factor for people to make mistakes. In particular, this is a flight attendant of a large airline, fully equipped with skills.
Currently, the case is still being investigated and clarified.
