The Orange County Superior Court of California decided to merge two civil cases, specifically the case of singer Dam Vinh Hung suing Mr. Gerard Richard Williams and the case of Mr. Gerard suing him, because they found the same facts and events.
Therefore, the case of Mr. Gerard v. Dam Vinh Hung, which was handled by Judge Nico A. Doubrath, will be transferred to Judge Michael J. Strickroth.
The hearing originally scheduled for January 12 was postponed. The Court will hold a hearing on July 7 at the request of one party.
The formal hearing of the case will take place on September 22. According to civil procedure, this is the first step before the official trial.
At this meeting, the judge will meet with the lawyers of both sides, review the status of the case and resolve any issues. If either side wishes to mediate or settle, the judge will record the results.
As for Bich Tuyen, she immediately responded to the media. She said that she has not yet received official information from the court about postponing the hearing on July 7.
According to singer Bich Tuyen, her lawyer shared that the hearing will still take place on July 7 according to court regulations and there have been no changes.
"On July 7, the lawyers of both my husband and Dam Vinh Hung are required to appear in court. The court does not allow a postponement. The information that the court will postpone until September is not true. Everyone should wait until July 7 to know more information," said singer Bich Tuyen.
When asked by reporters whether September 22 would be the first hearing in the lawsuit between her husband (Mr. Gerard Richard Williams) and Dam Vinh Hung, singer Bich Tuyen said that September 22 was just an assessment and review of the case by the court, not the official date of the first hearing.
To date, Mr. Gerard's legal team has a total of 6 people, including a female Vietnamese-American lawyer. After appointing a new lawyer, the legal representative of singer Dam Vinh Hung in the lawsuit demanding Mr. Gerard for 50 million USD is currently lawyer Tu Huy Hoang.
On January 22, singer Dam Vinh Hung submitted a request for a refund of 465.5 USD (11.8 million VND) including application and trial fees, electronic service fees... because the case had been merged.
The summary of the costs and confirmation of payment were then published on the official website of the Supreme Court of California, Orange County, at the end of January. Specifically, the singer spent about 447 USD (equivalent to 11 million VND) for filing and processing the application. In addition, he had to pay a number of other items such as: court, jury, interpreter and other legal fees related to the lawsuit...
Not to mention, the expenses that may arise are: document and evidence copying fees, attorney fees... which have not been specifically determined.
Under the US legal system, even though he is the defendant, Dam Vinh Hung must pay legal fees as prescribed by the court. Depending on the development of the lawsuit, this amount may be refunded or continue to increase. In the event that Dam Vinh Hung wins the lawsuit, he has the right to request that the plaintiff - businessman Gerard Williams - refund all or part of the above list of expenses.
According to the lawsuit, the incident began on February 19, 2024, when Dam Vinh Hung attended a party at Mr. Gerard's mansion in Newport Beach and was hit in the foot by debris from a fountain. The incident left the singer seriously injured, requiring the amputation of several toes and the cancellation of performances for the next two months.
He claimed the incident happened because Mr Gerard "failed to properly inspect and maintain the construction items" when using the fountain as a stage and outdoor drinks counter.
On November 4, 2024, the California Superior Court, Orange County, accepted the lawsuit. The hearing was scheduled to take place in June this year. However, in early December, Dam Vinh Hung suddenly withdrew the lawsuit and publicly apologized to Mr. Gerard.
After that, Mr. Gerard filed a counter-suing lawsuit against Dam Vinh Hung, demanding $1 in compensation and an official apology. He continuously added documents to the lawsuit and hired more lawyers for legal support.
For his part, Dam Vinh Hung has changed his representative lawyer and withdrawn his request to drop the lawsuit. He will return to Vietnam from the end of 2024 to celebrate Lunar New Year and prepare to return to singing.
The lawsuit between the two parties is still in the process of legal preparation. A month ago, the American tycoon demolished the fountain where the incident occurred to "change the feng shui".
