Recently, public opinion has been stirred up by the case of singer Dam Vinh Hung suing the family of Mr. Gerard Williams - the husband of overseas singer Bich Tuyen, who is currently living in the US. Notably, Mr. Dam and Mr. Gerard's family used to be close friends. Recently, an overseas female singer in her 80s shared her opinion on the case.

The female singer continued: "I heard 15 million dollars and I was so scared. Now I hear it's 50 million dollars. A fortune, I don't know if I'll be able to earn it in my whole life. Friends come to visit, if I'm unlucky, I'll just have to accept it, no one would sue. No friend would do that. Now they've turned into enemies. Legally, Dam Vinh Hung's lawsuit is not wrong. But emotionally, it's unreasonable.

I also heard Quang Le and Thuy Nga jokingly bring up the Dam Vinh Hung case, saying that Quang Le just bought a billion-dollar house and didn't dare invite friends over to play.

It is known that the incident happened in February 2024, at that time Dam Vinh Hung was invited by Mr. Gerard's family to his house in the US to attend a party on the occasion of the Year of the Dragon.

Regarding this case, public opinion believes that this lawsuit is extremely unreasonable and the possibility of Mr. Dam winning the lawsuit is very low.

However, from the perspective of a legal expert, Lawyer Tran Minh Hung - Head of Family Law Department (Ho Chi Minh City Bar Association) has a more objective view of this lawsuit.

Lawyer Hung said that in the world, there are many similar lawsuits on legal relations like the case of singer Dam Vinh Hung. Most of the causes come from product owners, owners, trademarks, manufacturing companies... not posting warning notes, notes when using specific products, leading to damage to the health, spirit... of users, consumers.

Lawyer Hung said that, for Mr. Dam's lawsuit, the singer's lawyer may argue that the homeowner did not give warning instructions or notes when he was about to climb up but did not stop him. In some countries, when a guest suffers any damage, the homeowner must also be involved in the compensation issue.

"I think this is the main reason Mr. Dam filed the lawsuit and perhaps the lawyer advising the lawsuit is a lawyer practicing in the US, maybe not a lawyer practicing in Vietnam. Because in Vietnam, similar lawsuits are not many and few people file lawsuits like this," said Lawyer Hung.

However, compensation depends on many factors such as law, subject,... such as the compensation insurance unit or the event organizer being sued in the case.

"Personally, I think this is a good legal case, opening up the right to sue, the rights of customers when using products without proper instructions or attention to the product,... causing damage to the health, spirit, and life of consumers," Lawyer Hung analyzed and said that this is a case where US law may apply precedent.

According to the Lawyer, Precedent is a form of law. Accordingly, the State recognizes the judgments and decisions of the Court to resolve cases as models and basis for making judgments for subsequent cases or circumstances with similar circumstances or issues.

In addition, Precedent Law is also the process of law making by the Court in recognizing and applying new principles. This is a form of law that occupies an important position in the Anglo-American legal system. Therefore, these lawsuits often occur in countries following the Anglo-American legal system.

"I don't know the outcome of the lawsuit, but from the perspective of a legal practitioner, I support similar lawsuits," Lawyer Hung added.
