TikToker Su Tu An Chay (real name Lam Quach) â the first person to bring Quang Linh Vlogs and Hang Du Muc's Kera vegetable candy for inspection â suddenly posted an apology video on his personal page.
In the video, he said he realized his mistake after reading an analysis by a media expert, saying that the act of bringing the product for testing and then publishing the results online was against the process and could even put himself at legal risk.
From a legal perspective, speaking with reporters, lawyer Diep Nang Binh - Head of Tinh Thong Luat Law Office (Ho Chi Minh City Bar Association) said that the 2015 Civil Code, the 2010 Food Safety Law, the 2023 Consumer Rights Protection Law and other legal documents do not have specific and clear regulations on "not prohibiting or restricting consumers from testing food".
Firstly, in Article 5 of the 2010 Law on Food Safety and Article 10 of the 2023 Law on Consumer Protection (prohibited acts regarding the protection of consumer rights and food safety), there are no prohibited acts or restrictions on consumers' right to bring the products they have purchased for testing at testing units.
Second, a product buying and selling relationship has been established between consumers and product sellers, therefore, the product seller's announcement of criteria regarding: properties, uses, ingredients, and quality of the product must be based on consensus and agreement in accordance with the announced content.
According to Clause 2, Article 432 of the 2015 Civil Code, in case the product quality standards have been announced, all information about this product must be correct, appropriate, and not lower than the announced quality. According to Clause 3 of this Article, if the parties do not have another agreement on product quality, the announced criteria will be automatically applied.
Returning to the issue, the lawyer said that, based on the provisions of the law, there are currently no regulations prohibiting or restricting consumers from bringing products for testing.
Specifically: First, this testing does not violate the general provisions of the law on prohibited acts, on agreements regulating the quality of announced products.
Second, food consumers have the right to: be provided with products, goods and services that are in accordance with the contract (Clause 3, Article 4 of the Law on Consumer Protection 2023), the right to request truthful information on food safety and the right to request organizations and individuals producing and trading food to protect their rights according to the provisions of law (Point a and Point b, Clause 1, Article 9 of the Law on Food Safety 2010).
Third, if consumers have doubts about the declared product quality, they may have the right to request an organization to test and verify the information and product quality on the declared labels and packaging to ensure the honesty and health safety as stated.
At Point a, Clause 1, Article 45 of the Food Safety Law 2010, other relevant individuals have the right to request food testing. Testing must undergo a series of appropriate tests and assessments based on regulations and standards for products and substances in the products (Clause 2, Article 7 of the Food Safety Law 2010), which cannot be performed by consumers, so there needs to be a specialized appraisal organization, such as Quatest 1, 2, 3 units, which are authorized and specialized units licensed to conduct testing and meet all testing criteria (such as Quatest 2, which is an exclusive specialized appraisal unit designated by specialized management ministries on product and goods quality, etc.).
Notably, after the vegetable candy 'chain' was expose.d, many surprising details behind it were gradually revealed. The leader of the People's Committee of Krong Bong district, Dak Lak province affirmed that Yang Mao commune is not the area where raw materials for making Kera vegetable candy are grown.
According to this leader, through information gathering, representatives of Asia Life Joint Stock Company have only come to Yang Mao commune, providing seeds and fertilizers to cooperate with people in growing ginger. Currently, only a few households have planted seeds and grown ginger, but have not harvested yet, so this cannot be considered as the raw material growing area of Asia Life Company to produce Kera vegetable candy.
"Currently, people have just planted ginger seeds and have not harvested them yet, while Kera vegetable candy has been produced before. Therefore, Yang Mao cannot be considered as the area growing raw materials to make Kera vegetable candy," said this leader.
