It can be applied to a person who is suspected of committing a crime or is proposed to be prosecuted and through verification there are sufficient grounds to determine that such person is suspected of committing a crime, it is necessary to immediately stop the escape or destroy evidence.

At the stage of investigation and verification of information on crimes, the authority to issue decisions on suspension of exit belongs to the heads and deputy heads of competent investigating agencies, under the inspection and supervision of the procuracies of the same level.

Regarding the time limit, the law does not have specific provisions on the period of suspension of exit, but according to the provisions of the Criminal Procedure Code 2015, the period of suspension of exit must not exceed the time limit for settling sources of information about crimes.

For cases where the denounced, prosecuted or accused are in the investigation stage, the preventive measure shall be cancelled only when the competent investigating agency issues one of the following documents: Decision not to institute criminal cases; The decision to suspend the investigation or the case or the decision to suspend the investigation of the accused or the case to the accused.

In case there are insufficient grounds to serve procedural decisions when the time limit for application of preventive measures is about to expire, according to the guidance in the Joint Circular No. 04/2018/TTLT-VKSND-BCA-BQP, before the expiration of the 10-day time limit for application of preventive measures, the investigating agency must issue a document clearly stating the grounds, reasons and propose the procuracy to extend the time limit for application, cancel or replace the preventive measure.

When suspending the investigation of a case or suspending the investigation of the accused, the investigating agency must make a written request to the procuracy to cancel all approved deterrent measures, clearly stating the reason, enclosed with evidences and documents proving the grounds for suspending the investigation of the case or suspending the investigation of the accused.
