At around 9:00 a.m., the Ho Chi Minh City People's Court opened a meeting to examine the submission, access, disclosure of evidence and mediation of the inheritance dispute between the plaintiff Nguyen Binh Phuong (40 years old, Duc Tien's wife) and the defendant Nguyen Ngoc Anh (73 years old, mother-in-law).
Because he was in the US, Binh Phuong authorized a legal representative to attend the mediation session, but this person was absent, only his lawyer attended. Ms. Ngoc Anh also did not come to court in person due to health problems, and sent a lawyer to represent her.
At the session, the judge asked the parties to reconcile but failed. The plaintiff and defendant maintained their original lawsuit and counterclaim. Ms. Anh added a request to determine that the land plot in Long An was Duc Tien's separate property (previously considered to be joint property with Binh Phuong during the marriage), and requested the court to adjust the inheritance ratio.
Responding to the media, Binh Phuong said that he respects Duc Tien's will and avoids making statements that could affect the deceased's image. Meanwhile, Ms. Ngoc Anh is actively working with lawyers to protect her legal rights. Recently, she has prepared more documents and evidence to present to the court.
Previously, the lawsuit over the inheritance of the late artist Duc Tien was accepted by the Ho Chi Minh City People's Court from the end of 2024. After Duc Tien passed away, his wife, beauty queen Binh Phuong, submitted a petition to the court requesting to receive her husband's assets, including the house in Linh Dong ward, Thu Duc city, Ho Chi Minh City and land plot No. 1841 in Duc Lap Thuong commune, Duc Hoa district, Long An province.
At the same time, she requested that her mother-in-law, Ms. Nguyen Ngoc Anh, and her daughter, Phuong Mai, each receive a portion of Duc Tien's inheritance according to the law.
However, Ms. Ngoc Anh countersued, saying that the house in Thu Duc was bought by her and her son in 2009, but was registered under the son's name. Later, Duc Tien immigrated to the US in 2011, and she and her eldest daughter continued to live there and continued to pay taxes and fees.
In addition, Ms. Anh requested the court to annul the legal value of the will that Duc Tien made in the US on August 9, 2023 (according to Binh Phuong, this will left assets to his wife), on the grounds that it is invalid in Vietnam.
From there, Duc Tien's biological mother asked the court to determine that the house in Thu Duc is the joint property of her and her son, so she will receive 50%. In case the court does not recognize the joint ownership of the house in Thu Duc, Ms. Anh cited Precedent No. 05/2016 on contributions in managing and restoring the heritage, wanting to receive 20% of the house's value, the remaining 80% will be divided equally among the heirs, and she will also receive a portion.
In the counterclaim, Ms. Anh presented her difficult circumstances, hoping to receive the house and pay cash to her daughter-in-law and grandson. Regarding the land in Long An, which is the joint property of Duc Tien and Binh Phuong, Ms. Anh requested to receive a portion of the 50% of her son's inheritance.
