"Nathan Lee's trademark registration of Cao Thai Son for his groups of products and services is not in the first case, so it can be considered and certified by the National Office of Intellectual Property," said lawyer Mach. However, he can also be refused, especially for group 41 (including entertainment products and services, performing arts and fashion shows, film and television production, etc.) because this is a group of products closely related to the profession and popularity of singer Cao Thai Son.
In the position of Cao Thai Son, according to lawyer Mai, if the male singer finds that his name has been taken away by his colleagues for trademark registration, it will affect his legal rights and interests, he has the right to object to the Department of Justice. intellectual property, it is recommended not to grant a protection title to this mark.
This right is provided for in Article 112 of the Intellectual Property Law. Specifically, "from the date the property registration application is published in the Industrial Property Official Gazette, up to the date of the decision on granting a protection title, any third person has the right to give opinions to the management agency." Opinions of the objectors must be made in writing, accompanied by documents or cited sources of information for proof.
Currently, the application for trademark registration of "Cao Thai Son" by singer Nathan Lee is considered by the National Office of Intellectual Property according to the provisions of Article 119 of the Intellectual Property Law. That is, within 9 months from the date of publication in the Official Gazette, the application for registration of a mark will be accepted if the conditions prescribed by law are satisfied.
