In recent days, public opinion has paid special attention to the case of WAG Chu Thanh Huyen - wife of football player Nguyen Quang Hai - who was expose.d for selling smuggled cosmetics without Vietnamese labels, not issuing invoices when selling goods, and evading taxes.
Talking to lawyer Nguyen Van Tuan, Director of TGS Law Company Limited (under the Hanoi Bar Association) about this issue, he said that if the authorities determine that there is a violation, the person accuse.d by others may be subject to administrative sanctions, forced to recall and destroy the infringing goods, or in cases where there is sufficient evidence to show that the act has signs of a crime, the case file can be transferred to the investigation agency for handling according to the provisions of the Penal Code.
If the verification results confirm a violation, the person accuse.d by others in this case, Ms. Chu Thanh Huyen, may face many legal sanctions:
The first is the cosmetics business without a Vietnamese sub-label. A sub-label is understood as a label showing mandatory content translated from the original label of the goods in a foreign language into Vietnamese and supplementing mandatory content in Vietnamese according to the provisions of law that the original label of the goods lacks.
In addition, the secondary label must be attached to the goods or commercial packaging of the goods and must not obscure the mandatory content of the original label.
Penalties for importing goods without Vietnamese sub-labels are determined based on the value of the violating goods, for example: a fine of VND 500,000 to VND 1 million for violations with goods worth up to VND 5 million; a fine of VND 1-3 million if the value of the goods is from VND 5-10 million; and the fine increases gradually according to the value of the violating goods, up to VND 15 million for violations with goods worth over VND 50-100 million.
In addition, this Decree on fines also stipulates remedial measures, including forcing the recall of violating goods to carry out proper labeling before continuing to circulate on the market.
Second, not issuing invoices when selling goods. According to Article 24 of Decree No. 125/2020/ND-CP, this act can be fined from 10 to 20 million VND.
In addition, in case the tax authority determines that the seller intentionally does not issue an invoice to evade tax obligations, he/she may be prosecuted for tax evasion under Article 200 of the 2015 Penal Code (amended and supplemented in 2017). Accordingly, violators who have been administratively sanctioned for tax evasion but continue to violate may be prosecuted with the highest penalty of up to 7 years in prison, a fine of up to 4.5 billion VND and a ban from holding a business position for 1-5 years.
Third, false advertising, causing misunderstanding about the product's uses. False advertising causes misunderstanding about the price, uses, or origin... of the product, especially it can affect the health of consumers. Therefore, it will be subject to administrative sanctions, and may even be prosecuted criminally.
False advertising can also be prosecuted under Article 197 of the 2015 Penal Code, with a maximum penalty of up to 3 years of non-custodial reform.
In addition, offenders may also be fined from 5 to 50 million VND and banned from practicing a profession or doing a certain job for 1 to 5 years.
In addition to the above incident, Ms. Chu Thanh Huyen has been involved in many controversies due to her unverified statements and advertising activities that show signs of exaggerating product effects. In particular, some of the products she introduced were said to not have sufficient product declaration documents according to regulations or have not been tested for quality by competent authorities. Livestreaming advertising and selling cosmetics and functional foods without issuing invoices or clearly listing product information is an act that shows signs of violating regulations on e-commerce, advertising and taxes.
The incident became more serious when information emerged that some powdered milk products distributed by Ms. Huyen were suspected of not meeting quality standards, showing signs of being made outside standards, and even at risk of violating food safety regulations.
Arbitrarily producing or advertising milk products or functional foods in powder form (such as colostrum, height-enhancing milk, brain-boosting milk, etc.) without declaring the product or exaggerating its effects can result in a fine of up to 100 million VND or non-custodial reform for up to 3 years. If tax evasion is from 100 million VND or more, criminal liability can be prosecuted under Article 200 of the Penal Code, with a maximum penalty of up to 7 years in prison and a fine of up to 4.5 billion VND.
