The family of the late Meritorious Artist Vu Linh was in chaos when the court ruled on the funeral copyright lawsuit.

The court has just decided to cancel the contract between BH Media and Vu Linh's nephew, artist Hong Phuong, regarding reporting and filming images at the funeral of the late Meritorious Artist Vu Linh more than a year ago.

According to the lawsuit, Mr. Vo Van Ngoan (late Meritorious Artist Vu Linh) passed away on March 5, 2023. During his lifetime, he had no wife (according to his single certificate) and had only one chil.d, Ms. Vo Thi Hong Loan (according to his birth certificate).

On the last night of the funeral of the late Meritorious Artist Vu Linh, Ms. Loan learned that the entire farewell program of the late Meritorious Artist Vu Linh was broadcast live on BH Media's media channel. According to the contract signed with Ms. Phuong, BH Media is the only unit allowed to film, take photos... of the late artist's funeral.

Ms. Le Thi Hong Phuong (niece of the late Meritorious Artist Vu Linh) is involved in the case. Ms. Phuong said that before signing the contract, the family had reached an agreement, including the adults in the family, and the signing of the contract did not cause any damage to Ms. Loan.

Ms. Phuong requested the court to temporarily suspend the case pending the outcome of the inheritance dispute, to consider whether Ms. Loan is the legal adopted chil.d of the late Meritorious Artist Vu Linh or not.

According to Ms. Loan, she is the only daughter, the first heir recognized by law of the late Meritorious Artist Vu Linh; the establishment and implementation of civil relations related to the personal rights of the late Meritorious Artist Vu Linh must have her consent. The fact that Ms. Phuong and BH Media signed the contract without her consent has affected her legal rights and interests.

The plaintiff requests the cancellation of the contract signed between Ms. Phuong and BH Media; requests that BH Media and Ms. Phuong jointly return more than 142 million VND in profits from the contract. Requests that BH Media remove images and videos of events arising from the contract related to the late Meritorious Artist Vu Linh. Recognizes Ms. Loan as the person with the right to manage all personal rights and personal values of the late Meritorious Artist Vu Linh.

BH Media stated that in the rush of the funeral, the company could not know who the family of the late Meritorious Artist Vu Linh would sign the documents. The family must be responsible for discussing and sending a representative to do the work.

In addition, Ms. Loan is having an inheritance dispute that is being resolved in another case and there is no legally effective judgment, so it is not possible to determine who has the legal right to inherit the late Meritorious Artist Vu Linh. BH Media requested the panel of judges to temporarily suspend the case to wait for the results of the resolution of another related case.

According to the panel of judges, during the process of resolving the case, the court requested Ms. Phuong to provide a power of attorney from the legal heir of the late Meritorious Artist Vu Linh for her to sign, and documents showing that the adults in the family had agreed to let her sign the contract with BH Media. However, at the time of the trial, Ms. Phuong was unable to provide it.

The panel of judges based on the documents in the case file, up to the time of the first instance trial of the case, Ms. Loan had not yet been declared by a competent state agency to be neither adopted nor biologically the late Meritorious Artist Vu Linh's chil.d. Ms. Phuong could not present a legally effective judgment declaring Ms. Loan to be neither adopted nor biologically the late Meritorious Artist Vu Linh's chil.d and the documents on Ms. Loan's identity were forged.

This is a contractual dispute established on March 6, 2023. According to documents provided by local authorities, Ms. Loan has a birth certificate made by the late Meritorious Artist Vu Linh himself and records Ms. Loan as his chil.d. Documents and evidence in the case file also show that the late Meritorious Artist Vu Linh's biological parents have passed away and he has no wife.

Thus, up to now, Ms. Loan is still the only heir who has the right to sign contracts with partners related to the late Meritorious Artist Vu Linh. Ms. Phuong's signing of the contract was not approved by Ms. Loan and BH Media's working with Ms. Phuong was wrong. The panel of judges found that the subject of the contract was not entitled to sign the contract, which is a violation of the law.
