Continuing the new developments in the case that shook the global entertainment industry of rapper Diddy, after the horrifying accusations, Diddy still did not plead guilty. According to PageSix recently, he and his team of lawyers filed a third appeal, despite being rejected twice before.
The news site revealed that Diddy's (real name: Sean Combs) legal team has just filed a third appeal to the court. The appeal opposes the decision of the Southern District Court of New York (USA) when it twice denied the rapper bail. The 55-year-old star's legal team is asking for the artist to be released immediately with appropriate bail conditions. The reason given by this side is that there is insufficient evidence to detain him and there are legal errors in the court's decision.
PageSix said the defense argued in its appeal that authorities failed to provide clear and convincing evidence that Diddy posed a danger to the public or engaged in witness tampering, calling the allegations âvagueâ and âspeculative.â The 55-year-old rapperâs attorneys went on to claim that the district court committed legal error by ruling âwithout a factual inquiry or analysis.â
Diddy's legal team argued that they had presented "an aggressive bail package with extremely restrictive conditions" that included house arrest with GPS monitoring, no internet or phone access, 24/7 surveillance, no female visitors (except family and the mother of Comnbs' children), and weekly drug testing. The team asserted that Diddy had so far complied with the legal procedures, pointing out that the "music mogul" had surrendered his passport.
Diddy was arrested last month on charges of conspiracy to traffic in sensitive material, fraud or coercion, and transportation to engage in malfeasance. The I'll Be Missing You singer has pleaded not guilty and remains in custody in Brooklyn, New York, awaiting trial. Prosecutors fear that the star, born in 1969, will seek out witnesses and obstruct the case if he is released on bail. They also believe that the rapper is a flight risk because Combs is wealthy and can use private jets. That's why the hip-hop artist has been denied bail twice.
Previously, Diddy was willing to pay bail of up to 50 million USD, using a 48 million USD mansion in Miami (USA) and his mother's house as collateral. In addition, Combs also affirmed to the judge that he was willing to wear a GPS tracking device, promised to limit travel to Miami and New York, and even announced that he would sell his private plane parked in Los Angeles. However, Combs' request was rejected.
Prosecutors previously said the father of seven abused and coerced women and others to satisfy his desires, protect his reputation, and conceal his actions for decades. Along with that, he created a criminal organization with many members and associates involved in trafficking in sensitive acts, sabotage, bribery, and obstruction of justice.
According to the indictment, Combs and his accomplices held numerous parties to satisfy their desire to use illegal substances. During these gatherings, the 6X rapper is accused of physically, mentally, and verbally abusing many people to get them to participate in the acts he often recorded. If convicted, Diddy faces a minimum sentence of 15 years in prison and a maximum of life in prison.
