A railway crossing guard at Thu Duc City refused to open the barrier when a train was approaching, so he was scolded and hit hard by a woman, causing a broken nose.
On December 31, Saigon Railway Joint Stock Company said it had just sent a quick report to the authorities about the assault of a female crossing guard. At around 8:40 p.m. on December 30, at the Uu Dam Pagoda level crossing in Thu Duc City (HCMC), the female guard closed the barrier to prepare for train number 4501 to pass.
While the vehicles were stopped waiting for the train to pass, two people on a motorbike demanded that the staff open the barrier to let them pass. When the staff at the level crossing did not agree, the woman cursed and got off her motorbike, then rushed to assault the staff member Vo Thi Binh (at this time the train was passing through the level crossing).
Despite being stopped by railway staff and passersby, the woman continued to attack the female barrier keeper. The incident was reported to the Hiep Binh Chanh Ward Police, Thu Duc City and the woman is currently being detained. According to the company, the female barrier keeper Vo Thi Binh was taken to the hospital for emergency treatment. According to the hospital's initial diagnosis, the barrier keeper suffered a broken nose.
On December 31, Hiep Binh Chanh Ward Police in coordination with Thu Duc City Police said they had invited the woman who assaulted the barrier guard to come in for questioning and take her statement. On the same day, the police also took the female barrier guard for a disability assessment to have a basis for handling the case.
Currently, there is no legal document that defines intentional injury. However, it can be understood that intentional injury is an act of intentionally violating the body, causing harm to the health of another person.
A person who intentionally causes injury to another person, if there are sufficient signs of constituting a crime, may be prosecuted for one of the following crimes:
Crime of intentional infliction of injury (Article 134 of the Penal Code 2015, amended 2017):
Anyone who intentionally causes injury or harm to the health of another person with a bodily injury rate of 11% to 30% or less than 11% but falls into one of the following cases, shall be subject to non-custodial reform for up to 03 years or imprisonment for 06 months to 03 years:
Using weapons, explosives, dangerous weapons or tricks that can harm many people;
Use of dangerous acids or dangerous chemicals;
For people under 16 years old, women who are known to be pregnant, the elderly, sick or others who are unable to defend themselves;
For your grandparents, parents, teachers, those who raised and treated you;
Organized;
Abuse of position and power;
During the time of being detained, temporarily detained, temporarily imprisoned, serving a prison sentence, serving a judicial educational measure at a reform school or serving an administrative violation handling measure of being sent to a compulsory educational facility, to a reform school or to a compulsory drug rehabilitation facility;
Hiring someone to injure or damage the health of another person or causing injury or damage to the health of another person due to being hired;
of a hooligan nature;
For a person on official duty or for the official reasons of the victim.
Committing a crime in one of the following cases shall be punishable by imprisonment from 02 to 06 years:
Causing injury or damage to the health of another person with a bodily injury rate of 31% to 60%;
Causing injury or damage to the health of 02 or more people, with the body injury rate of each person from 11% to 30%;
Committing the crime 02 times or more;
Dangerous recidivism;
Causing injury or damage to the health of another person with a bodily injury rate of 11% to 30% but falling into one of the cases specified in points a to k, Clause 1 of this Article.
Committing a crime in one of the following cases shall be punishable by imprisonment from 05 to 10 years:
Causing injury or damage to the health of another person with a bodily injury rate of 61% or more, if not falling under the case specified in Point b, Clause 4 of this Article;
Causing injury or damage to the health of 02 or more people, with the body injury rate of each person from 31% to 60%;
Causing injury or damage to the health of another person with a bodily injury rate from 31% to 60% but falling into one of the cases specified in points a to k, Clause 1 of this Article;
Causing injury or damage to the health of 02 or more people with the body injury rate of each person from 11% to 30% but falling into one of the cases specified in points a to k, Clause 1 of this Article.
Committing a crime in one of the following cases shall be punishable by imprisonment from 07 to 14 years:
Killing;
Causing injury that disfigures another person's face with a body injury rate of 61% or more;
Causing injury or damage to the health of 02 or more people, with each person's body injury rate being 61% or more;
Causing injury or damage to the health of another person with a bodily injury rate of 61% or more but falling into one of the cases specified in points a to k, Clause 1 of this Article;
Causing injury or damage to the health of 02 or more people with the body injury rate of each person from 31% to 60% but falling into one of the cases specified in points a to k, Clause 1 of this Article.
Committing a crime in one of the following cases shall be punishable by imprisonment from 12 to 20 years or life imprisonment:
Killing 02 people or more;
Causing injury or damage to the health of 02 or more people, with each person's body injury rate being 61% or more, but falling into one of the cases specified in points a to k, Clause 1 of this Article.
- Preparing to commit a crime:
Anyone who prepares weapons, explosives, dangerous weapons, dangerous acids, dangerous chemicals or establishes or participates in a criminal group with the aim of causing injury or harm to the health of another person shall be subject to non-custodial reform for up to 02 years or imprisonment for 03 months to 02 years.
